My mortgage payments are due to Ocwen at the beginning of every month. My grace period lasts until the 15th.
On November 3, 2006, I made my payment to Ocwen using my bank's online payment. The payment was successfully transmitted and I received a confirmation letter from Ocwen, as I always do.
On December 1, 2006, I did this same process, as I do every month. Again, the letter was received from Ocwen to confirm my payment.
On January 4, 2007, I received a certified letter from Ocwen claiming that both November and December's payments had went through, but later came back as "insufficient funds" from my bank. In addition, they claimed I hadn't paid for January 2007, and charged me multiple late fees and penalty fees.
I called my bank immediately and had them look up my account. There was no record of any returned payments, and they printed out all my activity from the past 2 months to confirm. I then drove to a local branch in person and spoke to a Manager.
She confirmed that Ocwen did receive my money, and there were no problems. So Ocwen was 100% flat out LYING when they said the payments failed.
I called Ocwen and they threatened to turn me over to a collections agency if I didn't pay them all 3 months' mortgage + fees IMMEDIATELY!
I told them there was no way I was paying for November and December again! In addition, I told them that I had until the 15th to pay for January.
The man gave me a fax number to send my bank statements to. He then ignored the entire conversation we'd just had and said "So when are you gonna pay up?"
AHHH! After I got him off the phone, I faxed over a very detailed letter, which included bank statements as proof that they have been paid. I urged them to call my bank immediately because my bank is willing to do whatever they can to confirm that my payments were NOT returned!
I have Ocwen 3 times, and nobody has responded or contacted my bank. Meanwhile, Ocwen has been sending me truckloads of threats in the mail every single day since! I guarantee when I come home tonight, there will be more threats from them.
The bottom line is that Ocwen KNOWS I have paid them, yet they are trying to pull a scam anyway. I have all the evidence I need, and I'm not backing down until they admit their error.
I made January's payment today through my online banking, and Ocwen will have it within 48 hours. So no matter what they say, I have paid them for every single month and my bank has the records to prove it. I have never been late, and I have never had a returned payment.
They are making a poor mistake to think they can attack me when I have ALL EVIDENCE to prove I have never been late or missed a payment!
