My husband and I are homeowners in Oakland, CA. We have resided here for 11 years. 2 Years ago Option One Mortgage Bought our loan from Union Street Mortgage. Currently my husband and I are in pro per in Superior Court in a suit against OOMC for Quiet Title to real property,Cancellation of adhesion contract(forebearance agreement),Violations of the Truth In Lending Act,Fraud & forgery...to name a few.

Option One has been overcharging us 1,300.00 amonth on a forebearance agreement which my husband and I were forced into or we were told we'd lose our home. They have forged interest rate documents that we never signed and now our interest rate is more than 11% We now can barely afoord to keep our home & pay our bills. With three children one of which has cerebral palsy & cannot walk. They have violated my family for over 2 years & I beleive they will not stop until we are on the street. Please help us! Can you tell us if there is a class action lawsuit against Option Onbe Mortgage???? I beleive like so many others that they need to pay for their actions. Thank you Ondria in Oakland,CA

I have been on here looking at all these complaints against Option One Mortgage Corporation in Irvine California.There are over 130 reports ALL SIMILAR to my story.My husband and are In Pro Per in court (suing them without a lawyer) In The Superior Court Of the State Of California Alameda County-Hayward Division. Case Number RG08367128.I noticed that everyone complaining about OOMC's Predatory lending practices all have the same thing in common. We all want to know if there is a class action law suit against them. If you read my letter here to the judge regarding OOMC you may feel that you want to write your own letter as well. I am enclosing letters (complaints) from people on this website to the judge so that he can see how many people are being affected by OOMC's behavior and unfair business practices.If you want to contact me regarding a potential claim or complaint about OOMC and maybe we can form a class action lawsuit against them.Or write to your local news station or Judge Richard Keller.I am trying to find people that want to start a class action suit against them.All of us have suffered at the hands of Option One Mortgage.Please dont let them get away with it!!!! Option One Mortgage Corporation Alameda County Superior Court Case No. RG08367128 Dear Judge Keller: Your honor, My husband and I are the Plaintiffs, in pro per in this case. We filed our amended complaint on May 12, 2008. We hired a document preparer by the name of Craig Rawson to help us prepare our amended complaint. He failed to leave out the Eleventh cause of action for Quiet Title. On the first page of the complaint it clearly states one of the causes of action is for Quiet Title but as you can see upon reading the complaint the he has left out the 11th cause of action. We have re submitted the correct copy of our amended complaint to add the 11th cause of action for Quiet Title that was erroneously left out by the document preparer. The clerk filed it as having been a clerical error. I was told that there may be sanctions that can be imposed on the document preparer and that you can make him give us our $750.00 dollars back. We have been through a lot with this mortgage company, Option One Mortgage. We would like to ask if there is a way that we can have a hearing or file an injunction to be able to stop making payments to this company or pay our regular monthly payment until all of this is settled upon. My husband and I have tried to seek legal representation regarding this case. Unfortunately we cannot afford to hire an attorney. One attorney said that we have a great case but asked for $3,500.00 up front. Thats less than one months mortgage payment to OOMC! We have three kids one of which is disabled. We are sharing a vehicle and I have to commute over 4 hours a day to take my husband to and from work so I can have a vehicle to also take my daughter to school. My husband needs a new transmission on his truck that costs $1,500.00. He has no registration. We have been paying Option One all of our money that we need for every day necessities. Our eight year old handicap daughter requires special shoes because she has cerebral palsy and we cannot afford them. We need money to pay PG & E and EBMUD or they will be cut off. We have gone all winter long with no heater. We also have a bad roof that leaks. We have to put buckets in the dining room when it rains. We have mold and mildew in our dining room where our children eat everyday. We have suffered because of the adhesion contract that we were forced to enter into. We have to pay $1,300.00 more than the regular monthly payment. We have since entered new evidence and filed a motion for judicial notice that we never signed an interest rate note, or rider and that OOMC is holding us to a new interest rate of over 11%. We missed out on a $150,000 dollar 0% loan from the City Of Oakland because we were so called Behind in our payments we do not qualify for the loan which would help us with Home repairs. OOMC keeps trying to drag this whole thing out and we just want to resolve this. We have been living in our home for 11 years. We have always been able to pay for the mortgage except for now because of all the money we are paying Option One. My husband has started a new job because he can no longer be self employed because of the economy. This has caused us to suffer a huge pay cut. We need some thing done now. Some kind of results. If they keep prolonging this case we are surely going to be on the street. We are tax payers and deserve the right to be treated fairly by the judicial system. We have sought help from Senators and Congress. We are planning on calling news stations to help us tell our story. We do not know what else to do at this point. Our children need clothes & medicine. We cannot afford new pants for our daughter who cannot walk and crawls on her knees and wears out her pants. We feel we would like a special hearing to talk to you regarding just what we can do to speed this along. We would like to come to a quick resolution to our dilemma. OOMC has lied, called us names. forged documents (the adjustable rate note that we never signed .) We even have proof. We have told OOMC all of these things and they just laughed at us and would not even help us. We are going to send a copy of this letter to every news station out there because we need help & are disgusted with the acts of Option One Mortgage and how they have treated us. We also feel we havent been treated fairly in the judicial process maybe because we are in pro per. Attached are ten Complaint letters from OOMC customers from all over the country. This website Rip Off Report.com has over 130 letters from very unhappy customers of OOMC. These people have the same claims against Option One as we have that they are fraudulent, Predatory lenders ripping off the American public whom are all taxpayers and hard working homeowners with families. I did not want to exhaust the courts time so I only included 10 of them. There are over 130 on this website alone! I have found on the internet that there was and still maybe a class action law suit against them. I am researching that so that I can add my name to that suit. My husband and I are overwhelmed, frustrated, scared and mad. We do not want to lose our home as we have also found that we cannot even refinance to a desirable FHA, Fannie Mae or Freddie Mac loan only because OOMC says we are behind in our mortgage payments. Please read this letter & the attached letters from others who are also victims of OOMC s abuse & tell us what we are to do.
