I purchased one of Toris phones from the glamours life collection which was a $400 home telephone. I asked her before purchasing how long it would take because i needed it for the 23rd of January . I ordered on the 14th she said I would have it by the 23rd. I contacted her on the 22nd and she said it was going express mail and i would have on the next day, well it was a no show for my wifes birthday and it arrived the 24th. No present for my wife on her birthday. the phone arrived and crystals were  missing on it and the phone box was all beat up, poorly packaged, and worst of all the phone was used.

It had several hundred incoming calls over a month of calls at least on it, The speaker phone button did not work and all the number buttons stick so its not possible to call out on. I contacted her and she avoided all the issues and basically said that it was the postal services fault for delivery times and they must have damaged the phones. She does not want to do anything to take care of the problem and basically told me to stop contacting her because I bullied her because I put a youtube video up on the phone and it not working. I guess because I'm not a celebrity customer and just a run of the mill customer it doesn't matter if my phone works or if my wifes happy with her birthday present.

At the end of the day all I wanted was her to say i will send you another phone, nut that didnt happen she told me I was bullying her because she was a woman and i was a man and never offered to make the sale right, to get me  a phone that worked, All I heard was crap out of her mouth telling me that she inspects all her crappy work and everything is a1 before it goes out. She must of been sleeping on the job that day when someone forgot to inspect it and missed that it was a used phone.

In my original email response to the client I asked for photos that I could submit to the post office...so that I could be reimbursed for the insurance which I put on it. Which would have allowed me to design a new phone for him. He says the buttons were sticking...and the box was beat up. Which was not the case when I sent it. So they were responsible for paying for the redesign. This paypal response is AFTER he filed the dispute. He never responded to me directly after I asked for photos to submit a claim...I have given my side, and I will not continue to go back and forth when I know that he is not being 100% honest.

I would certainly not prefer to have this ripoffreport on my company. But I am not going to change my policies because someone is attempting to bully me. I offered to have the claim filed with the postal service, get a new phone, do another design, and have it replaced initially. He never replied to me. He just opened the paypal case. And no, refunds are not offered because all the work is custom made. It is impossible to have this as an option in a business like mine...no one offers refunds. But I do offer a Lifetime Warranty and INSURANCE to PROTECT the customer, and my company.

He just didn't want to wait and follow the steps...I did attempt to resolve this BEFORE he filed the claim. By doing that, he was basically saying, I'm not dealing with you... and as far as celebrities...since he keeps mentioning this...that is a SMALL percentage of my business. It is everyday people like myself buying my products daily. They are the ones that come back over and over. One person will not stop this because I would not allow him to bully me into a refund, when it was not MY direct error. I still would have gladly done the work to replace the damaged phone once the usps claim was approved. He just never gave me the chance.

I am not going to continue to "internet fight" with someone who  could have chosen to deal direct with me, but instead ignored me and tried to rip ME off. I have no idea what he has done to the phone after almnost 3 wks of having it. But I know what it looked like when I shipped it out. Just as EVERY SINGLE client before him has received, and since ...it was perfect. My clients LOVE their desk phones and every other product. And if they do not, I work direct with them to be sure they do. Anyone who has ever had an issue knows these words that I always say to them: "I want my clients to love the products I make for them as much as I do".

That was the same for him, however he never really gfave me the chance to do anything about it...he just tried to file a dispute on me without any opportunity to really assist him. There is the story...I have nothing more to add...I hate that it came to this. But I really cannot do anything else, just because he wants to bash me publicly...that still will not make me responsible for something I never did. The phones are all brand new. All the materials are brand new. If I were lying, I would have just given in and tried to avoid him doing all this public attacks on me. But I have no reason to run and hide. No matter how he tries to defame a name I have worked really hard to build the last 11 years.

posh life offered no help

First off their was never any offer by posh life bling to ever redesign a phone and for me to wait and reship another phone to me. When i contacted her about the issues I had with the phone she avoided all responsibility and just wanted to pass the buck onto the US Postal Service. Basically saying that the item was damaged by the postal service and i needed to file a claim and so on, The phone coming in late didnt matter. The item is in fact used , to say that it was tested is one thing but to have several hundred incoming phone caller ids is in fact not testing the phone . If you were testing the phone i can see a couple incoming and outgoing calls but these calls went back over a month. Not to mention the box was all beat up that the phone comes in which i will post pictures of. When you order a product you expect it to be new with a new box. The phone was shoved in the factory box and had duct tape holding it shut. If thats the attention to detail you give to your clients it should be looked at closely and reevaluated. The real issue is I paid for a new phone which i did not receive and its unusable because the buttons stick which will not allow you to dial out and the speakerphone does not work. All i want now is my money back and i will move on with my business elsewhere. She will not offer this or has never offered to send me another phone, All i got from her was an email saying i was bullying her, excuses and to stop emailing her. So at that point their was no other choice but to file a paypal complaint. I have attached her side of the story she gave to paypal basically excuses and if you read this never offers another phone to me. Only thing she is adamant about her return policy which their is none and their is no refund ..
PAYPAL COMPLAINT BELOW
1/29/2013 10:53 PST - Seller: This
phone was in perfect working condition, hand designed. We open the box
and test each phone before we design it with crystals, because the cost
of the Swarovski stones are so high, and we don't offer refunds because
all of the work is hand designed, custom for each client. So the phone
was not "used". It was tested, for the benefit of the customer, and to
protect ourselves. I can guarantee personally that each phone is tested
before designing. MLK day was Monday, and I shipped the package out on
the 2st express overnight mail. If it did not arrive in time, it was the
fault of the postal service, which shipping can be refunded. Because
the postal service has to guarantee that. But I did every single thing I
promised to do for the order. Design a working phone, perfectly, and
then ship out in time to reach the client. Our website states that
because all work is hand designed, I cannot offer refunds. The client
has to agree to this Before they purchase. I will work with him in any
other way he needs, however I cannot offer a refund because I know there
was nothing at all wrong with the phone. It was in perfect condition
when I shipped it (I photograph every item before shipping, for the past
10 years in business). And I tested it myself to be sure all the lights
and buttons worked, as well as getting a dial tone, and dialing...this
is a case of buyer's remorse. I did all that Iwas required to as a
designer, and shipped it On Time!

What a business owner ill tell you, stay away from this crook, nothing but a scammer selling used junk. If I was a celebrity this would have been taken care of by now.....

Response to Claim

#4REBUTTAL Owner of company

This client emailed me to tell me that he had received his phone and there were some issues. One it arrived late, and 2 there had been some damages. I do photograph every single design before they ship, and have done so for over 9 years. There have been times where products were damaged during shipment, and I use it for filing insurance claims with the postal service.

Before I design any item I make sure they work...and are not broken, etc...just something I have learned to do over the years.  I open it, test it to be sure it rings, lights up, calls out, basically performs all the actions it is supposed to. I do this BEFORE putting on any crystals, because what is the point of designing a phone that does not work. He was upset that numbers were in the phone...well, that is the answer why there were numbers. As far as the date, the Postal Service was closed on 1.20, MLK day. I had it picked up on 1.21 for OVERNIGHT delivery. EO928011440US That would have had the package delivered by the 23rd. I did all I was supposed to to get it delivered on time. For some reason, the postal service did not have it there on time. While I completely understand and agree with his frustration, I cannot understand why he is blaming me for it not being there. I even offered to refund the shipping fees..

When I received his complaints, I asked him to send me the photos of the damages and the beat up  packaging so that I could submit a reimbursement claim to the post office and redesign a new one. There are times when packages are destroyed during shipment. But I INSURE every single item completely, so that if it does get damaged while not in my possession, I can redesign it. The response from him was a paypal complaint.

I do understand and sympathize with him not having the package in time. However I worked over the weekend to make sure it was ready. I had it picked up in time, and paid the correct postage so that the package could be there on time. And the phone was in perfect working condition when it left...I offered to file the claim so that we could do another phone, but that wasn't good enough for him...and his response was to tell half truths all over the internet about my company. It is completely unfair and untrue and detrimental to my well being and ability to support myself and my sons. It is like being bullied, and yes...I do feel that if I were a man he would have handled the situation differently. I offered a resolution, which was a new phone. But of course it takes time to design a new phone. I don't just have phones sitting around designed already. Each one is made to order. He did not wait for that, and I suppose that is his choice. But then to say that I did not offer him a resolution is just a LIE. Over 90% of my business, for the past 11 years...is REPEAT CUSTOMERS. They come back over and over. You don't get to that point by mistreating people. I have excellent customer service skills and ethical business practices. I treat others as though I were the client. And a thousand clients will testify to this...they do, by shopping with me year after year. I have never had anyone do what this client did. All because he did not want to follow the steps that are required. As with any company, there is a process to how returns have to be handled. And he just wanted to skip that and throw out false accusations. Very unfair.
