Limitations and terms - modern legality

#2Consumer Suggestion

I am also an associate, though a very inactive one due to my close proximity to PPLSI corporate HQ in Ada, OK. I understand from the limited information that some of your issues were not covered by the policy. I want to apologize for what must be a frustrating experience and explain, if possible, how this may have happened. Pre-Paid Associates are recruited into the sales force and given educational information, documents, and training - which they are entrusted to fully explain to new customers. The binding agreement by contract, as stated in the membership form, is the document itself. While I assure you it is not pre-paid legal's intention to allow, some associates do not follow the guidelines in explaining limitations, fail to make them clear, or simply fail to provide an understanding despite their best efforts regarding the contents of the policy. In almost all States it is the responsibility of both parties to read and understand a contract, signified by its signing. Some states are more lenient than others and favor one side of the contract or the other. Ultimately, written terms override promises or statements as they are tangible and fixed in the contract paper. In an effort to keep the membership agreement as brief and clear as possible, the terms on limitation of services and specific events may be described through legal language which not all people agree is 'common knowledge', such as the definition of major surgery. In the eyes of the court these terms are actually well defined, but that can lead to serious misunderstandings of percieved coverage and scope for customers. As stated previously, it is hard to guarentee coverage for the most severe legal events, such as a Parental Kidnapping, while keeping fees affordable. I will not venture to say 'fair', because ultimately fair is a matter of best interest and satisfaction for both parties. The very fact that you are having a legal problem indicates that 'fair' is already in dispute and the services you seek should, in your mind, make it right for you. The courts decisions are not always fair. Nor are all attoneys or providers, nor associates for that matter, equally competent in all areas of the business and law. If you are having difficulty with your provider, please let your regional associate know and/or request substitution of contact with a rep higher up in the process for clarification. Some legal matters are very complex and require attention to determine coverage. Ultimately the policy does have written limitations which you should be aware of and should have been provided in writing along with your membership pack. If you have a need which falls outside those limitations the service can still provide referral to leading firms at a discount off of their regular fees but you are in no way bound to accept that service provider in exclusion of your policy. This ensures you obtain the best rate as a consumer and attempts to provide the initial consultation and basic legal defense descibed in the actual policy. No associate can claim (with the firm's approval) that -all- your legal trouble will end upon buying a policy. What PPLSI does guarentee is a basic level of service, consultation, and representation for common needs as well as a powerful liasion and lobby for quality in legal services from pre-screened providers that specialize in your specific area of need. I can tell you from experience that getting the wrong attorney can be WORSE than no attorney at all, and hope you will consider contacting PPLSI for resolution or consultation in your issue. Sincerely, James A. Allen - PPLSI Associate

I have ben an associate of prepaid Legal for three months thus far. I wholeheartedly disagree with the response on here. First and formoremost, if you have a complaint with a company, the company must know about it. Pre-Paid Legal has set it up that the law firms are monitored and quality is assured. The associate who introduced you to Prepaid Legal should be the first to know you are unhappy with the service. If he does not know, he or she can not help you get it resolved. Also, if one lawyer is not to the member's liking, another attorney will be assigned. Also, just as dental insurance for the weekly or monthly fee does not cover EVERY single thing that can happen in a person's mouth, so to does Pre-Paid Legal not cover every single occurrence that can happen legally. It is unfair to think for 26.00 a month, every single legal situation will be handled and that perception is not given out by pre-Paid legal, but often assumed by members who fail to read the specific agreement for his or her state.
