Early this year I went to the Ladies Premier Fitness Center on Kingsridge Rd. behind the Dayton Mall just to see if I could join on my friend's account. I went in and got a tour which was nice enough. I decided to sit down and speak with the man in charge of membership enrollment. He spoke very quickly and left me little to no time to think about what I wanted to do. He made me feel as if I had to sign on the dotted line. In retrospect, he glossed over completely the 3-day window to back out. When I walked out I was signed up with a 3 year contract, which again, was grossly unexplained and pressured. Shortly thereafter I no longer had the job I had when I signed up. What resulted was a pay cut that rendered the gym expense frivolous so I called to cancel my account with the gym. I called and it went straight to voicemail. I left a message. The message stated I didn't have any money in my account and to hold off withdrawing it, all they needed to wait was a day or so. I also requested they call to me discuss leaving the gym. They didn't and I got $100 in overdraft fees from my bank. I went into the gym and I was less than happy when I explained to them what happened. They said flat out, It's not our problem you lost your job, you signed it and you have to pay it. I asked to be let out and he said I couldn't. I asked again, How do I get out. He genuinely did not want to tell me what was going on. He let out a sigh, rolled his eyes, got up, and got a calculator. He said, If you want to get out of it you have to pay us over $900. I asked him how I could afford that if I was a full time student who couldn't pay $25?! He said, Again, not my problem. I left there and went home and called their 800 number. I wanted a copy of the original document they had. The first call and they said they would mail it within 3-5 business days. On this call I explained how I had called and told how I left a message. It was then they explained to me how they delete voicemail without checking it first. It was almost past the letter's arrival time so I called again and had them fax it. I received the fax and it was illegible. I called again and had it faxed and again it wasn't legible. So I called again, having not yet received the mailed version, and asked to speak with a Supervisor. I was told they were in a meeting or some such and she would call me back. It wasn't in a timely fashion.

After the fact I got a hold of her and explained to her my situation, how rudely I was treated, and how I'm a full time student, explained my employment situation, and the overdraft fee I incurred, and how I was told messages were deleted without being heard. I was told the same song and dance and when she became rude I admit I started swearing. I asked to be transferred to someone above her and she said she was it, that, There is nobody above me. After she refused to help me I hung up on her. After this happened I canceled my debit card and was issued another as this was how they were accessing my account. I continue to pay my account, but when I can. Four days late on my August payment and they slapped on a $15 charge. It's now October. They called me today the 24th, not only on my home phone I have on my paper as the number to call, but on my cell which they do NOT. They even went so far as to call my Grandparents and harassing them for the payment. I NEVER received ANY mail about the late fee. And I NEVER gave them permission call my Grandparents. I had them down as an emergency contact ONLY. This is beyond the pale and they need to be held to account for what they have done.
