I worked more than 20 hours for this company as a part time job that i commuted to after completing my full time job, M-F. When I interviewed, before I accepted the job, I explained to the person who hired me(as a telemarketer working in an open office with supervisors for set hours following a script, using company phones and a company computer system) that I needed to be guaranteed some form of hourly pay or I would not take the job. I had been scammed by a marketing company that stole my labor about 10 years ago and did not want a repeat. The person who hired me, AJ, assured me that 1) even though the company claims telemarketing employees as 1099s(though they meet every IRS criteria for employees and are clearly not in business for themselves as contractors), and even though the company promised less than the legal minimum wage($6/hr instead of $7.25/hr, which is the legal minimum wage in Virginia) that I would indeed be guaranteed to be paid something hourly regardless of lead and sales outcomes.
Everything promised about tne nature of the leads was false; the leads I was working on were in lists about a year old, and had been called dozens of times.
I was denied $6/hr based on fine print in the contract which stated a lead minimum, and was paid nothing for my time.
