Pressler & Pressler/ Pallisades Collection LLC has been coming after me for numerous debts that I supposedly owe since 2004. At first, being naive, I paid off one debt in full and am $800 away from paying off a (2nd) $6000 debt. In March 2009, my joint bank account was levied in the amount of $1200 for a (3rd) debt that I allegedly owe from the birth of my son in the year 2000. I was on Medicaid at the time but Medicaid no longer has records from the year 2000 so I can not prove it. Being that I can't prove that I was on Medicaid I entered into a payment arrangement with P&P in the amount of $100 per month that was supposed to start on 4/25/09.

Today, 4/22/09, I logged into my bank account only to find that it was once again levied by P&P. I called and they can't figure out why it was levied because we have a payment agreement in place. They are going to try to "figure out" what happened. Now, when I got home from work today, I received a notice that I'm being sued by them AGAIN for another (4th) debt that I allegedly owe to Verizon from the year 2002. I really don't know what to do anymore. I honestly can't take this anymore and am pretty much on the verge of a breakdown at this point! How can these people keep coming after me again and again for any little thing they dig up from the past? How can I stop them? Please help!

Pallisades is a junk debt collections agency.  They attempt to collect on debts past the statute of limitations (SOL) and often these junk debt accounts are well over 7 years old and any debt past 7 years old (except student loans and Federal loans) cannot be reported on your credit bureau file or affect your credit rating.  These bottom feeders are hoping you dont know this and will make a preliminary small payment on the debt thereby restarting the date on the outdated debt and making it now reportable to your credit files.

First, If you are contacted by any of these bottom feeders there are a few key things you need to keep in mind.  If you receive a summons or are asked to go to court dont blow it off.  Make sure you show up with information showing the debt is past the statute of limitations.  If you fail to show up with proper

preparation, they can get a default judgment against you and youre screwed.

Secondly, do NOT pay them anything this will only restart the SOL.

Third, you do not need to deal with them talk to them, or let them harass you or your family.  Send the following letter to them certified return receipt.  If they violate the terms of the letter haul their sorry asses into court and sue them.   Small claims court is fine.  Don't threaten them verbally over the phone, send the letter and take action.  They will ignore you if you just "talk" about it.

To Whom It May Concern:

This letter is response to your phone call on/letter dated __________, concerning the above referenced account number.

I have checked and (either the debt is not mine (or) I have checked with my state Attorney General and confirmed that the statute of limitations on this type of debt has expired). If you choose to pursue this matter in court, I will be able to show either (the debt is not mine (or) proof that the statute of limitations has expired) and you will lose your court case.

This letter serves as official certified notification that I do not wish to be contacted about this debt any further except to be notified that future collection efforts are terminated. Any further communication by any means to myself, my employer, my family, neighbors, or friends regarding this debt will be taken as a violation of the Fair Debt Collection Practices Act and will result in my filing a lawsuit against your firm.  Additionally, I will lodge a formal complaint with the Attorney General of both my State and the State in which you operate as well as a formal complaint with the FTC.  I will also file a lawsuit against you should you should report any negative information on any of my credit files or in any way attempt to negatively affect my credit rating.

My husband AT &T Wireless service in 2003, which we terminated the following year due to a billing dispute. In 2006, we began to hear from these scumbag lowlifes and I told them the bill was in dispute. By 2008, they began to harass my husband's parents, declining to saw how they even got their phone number- We certainly didn't give it to them. His parents are nearing seventy and are not well. His mother has cancer and his father is an amputee after a serious car accident in December 2004 in which he was nearly killed. Therefore, I would come down very hard on anybody who harassed them. Besides, contacting them is illegal under the FDCPA because since they have sent us letters directly and called us, they very clearly have our location information. The only reason a third party collection agency can call a relative or a friend is to obtain your location information. Once they have said information, such contact is illegal. Also, contacting a debtor before 8 am and after 9 pm is also illegal under the FDCPA, which they did this morning. I am a teacher, so I am obviously on summer vacation and DO NOT APPRECIATE such contact before 8 am. I tried to inform them that we retained a lawyer to sue them for multiple violations of the FDCPA and as I attempted to give them her information and refer all contact to her, they threatened to call whenever they wanted and to harass his parents again. I reported their contact to both my lawyer and AT &T Wireless and informed them that if they did not stop Palisades from harassing me and my family, I will ask the lawyer to include AT &T Wireless in any lawsuit for violation of our rights under the FDCPA.

Jennifer, Since this goes back to 2000, then it's past the statue of limitations in New Jersey (six years). Contact Legal Services for further help.

Jennifer, You need to do a stop payment on these transactions then close the account and reopen it with new#s . If his agency calls and asks for the new account # refuse to give it. This is why you never give bank imformation to these scumbags they will rip you off. I would send them a cease letter certified but keep a copy for your self
