My apartment was burglarized on June 1,2011.  On June 2, 2011 we meet with the Manager Shelly and we discuss the steps to get out of our lease.  She stated that we pay a Re-let fee and and rents until it is rented.  The apartment was rented in 10 days.

On June 21, 2011 I get a bill for an additional 2 months rent.  I called the office and talked to Shelly and she understood but I must talk to Mary Huff.  She got on the phone and stated that I will pay the full amount or she will turn it into a collection agency.  I told her that I had all the real estate courses to set for Texas Real Estate exam and I believe that she was wrong. I told her I will have to retain a lawyer and she stated "Good for You, I go to court every month".  I also stated I would be picketing the apartments.  She stated " you are fixing to get yourself in a lot of trouble".  

I talked to the Manager Shelly again and she wanted to help but I am not sure who is steering this ship the manager or Mary Huff the book keeper.  When I told Shelly that I would be picketing the apartments she stated she will call the cops.  I stated the the sidewalk is city property and that I have 1st amendment rights and that I have already done this at a car lot. 

I called my real estate instructor who is the former Chairman of the Board for the TREC Broker and Lawyer committee to get his opinion.  He stated "their losses have been mitigated.  The TAA lease does not provide a 2 month penalty just lost rents and a re-let fee.  He gave me the name of an attorney which I called and am waiting for a return call. 

The act of extorting; the act or practice of wresting anything from a person by force, by threats, or by any undue exercise of power; undue exaction; overcharge.

The threat of trying to collect rents that I do not owe and the threat of turning it into a collection agency is extortion by definition.

The Police officer that investigated the break in stated the apartments and the area in general has a heavy criminal element.  Stated that we should not be living in this zip code 75254.

I will be picketing the apartments as soon as I talk to the attorney.  Come and see me on location.  I am retired and have nothing to do.  Doctor says I should walk more so walking up and down the sidewalk in front will now be included in my exercise program.

The Apartment Division Manager called today and corrected the amount owed  She apologized for the incident.  Future tenants will benefit from the correct way of figuring move outs. 

Now as for the crime in the area. It is what it is.
