with the BBB due to its failure to substantiate or modify advertising claims

On January 31, 2007, the BBB contacted the company about concerns the BBB had with its advertising.

The BBB asked the company to provide scientific substantiation for the claims that the company makes about its nutritional supplements, and the BBB asked for the company to provide licensing information that would prove the company could legally include the word pharmacy in their company's name.

According to the BBB Code of Advertising BBB Definition:

, "claims as to energy savings, performance, safety, efficacy, results, etc. which will be obtained by or realized from a particular product or service should be based on recent and competent scientific, egineering or otherobjective data."

On February 1, 2007, the company informed the BBB that they are not licensed by the Texas Board of Pharmacy. The BBB asked the company to discontinue the use of the word pharmacy in its name, but the company has not discontinued its use of the word.

The company was not able to provide scientific substantiation for its supplemental product claims, but the company did disclose that the products have not been evaluated by the Food and Drug Adminstration.

I am glad to be able to respond to the seemingly negative remarks posted by Walt concerning our company, Pro Net Marketing and the use of our trade name, ProBLEN Pharmacy. First, before I address the use of the Dallas BBB's web information I would like to explain why I believe Walt has created the post. Walt is a disgruntled customer who certainly can post and say whatever he wants to. This began when we refused his refund request. Walt threatened and tried to extort a refund from us. Had he simply asked for a refund during the 90 day 100% money back period we would have been happy to give Walt a full refund as we have done, when asked, on every occasion during our 11 years of business. Instead of accepting responsibility for his negligence, (all he had to do was request a refund to receive one in the 90 day period) he threatened us and said he would do everything he could to hurt us and our good name. Secondly, let me respond to the remarks posted on the BBB's website. In 2006 we did apply for membership with the greater Dallas BBB as a local business. During this time we were in temporary offices while we were building our new corporate location (which we moved into March of 2008) and did not have a physical storefront and thus did not qualify for the membership we requested. We withdrew our membership request and asked to be refunded the membership fees we had paid, and they did. During 2006 while in the application process they mentioned that in Texas any business using the name pharmacy had to be a registered pharmacy to be a member of the BBB. We explained our company's name is Pro Net Marketing and ProBLEN Pharmacy is only our product trade name. It stands for PROfessionally BLENded PHARMACY (the science or profession of dispensing medicinal drugs). Our homeopathic formulas are exactly that, they are over the counter remedies (drugs)formulated by professionals in the medical, pharmaceutical, homeopathic and nutritional fields. ProBLEN Pharmacy is our product trade name, and not the name of our business. I have checked all of our corrospondence with the BBB and found no requests for documentaion concerning our products, their ingredients or efficacy. I think the educated and informed consumer can find literally millons of documents concerning the ingredients we utilize and thier effectiveness. Since we never completed the process it seems they left the file as uncompleted and/or unsatisfactory. I was unaware of this until now so I do thank Walt for bringing this to my attention. I called the BBB but they had already stop taking calls for the day (they stop at 3pm). I will pursue getting the information corrected, starting with our personal names. I would ask the reader to please note that the BBB mentioned they have never had a complaint against us in the past 3 years or as a matter of fact for the entire 11 years. We have thousands of satisfied customers and also a few who requested refunds during the 90 day policy period and received them. I admit there have also been a few Walt's too, but none ever followed through with their extortion threats as he has. We are sorry it has happened, but I guess I should be glad that in 11 years this is the first complaint, especially since it is unfounded.
