Tell us has your experience with this business or person been good? What's this?
I was on the internet lookign for cash advance and I gave some personal information but I did not give any comoan y permission to take money from my bank account and furthermore I did not have any knowledge that money would be taken from my account.

I have had overdraft fees of 25.00 every five days because of the insufficient funds in my account because they tried to withdraw 24.95 On March 19, 2009 and the money was not there and I did not know that they were trying to get money from my account until I seen my bank statement.

I am very upset and If someone is not willing to do soemthing about this problem then I am going to go to a higher power and my attorney and I am going to go threw the paperwork to begin a lawsuit. This is not right and I know a lot of people have been having this problem with the same company. They tell you they have money for you and then they take money from you and like me I didn't have the money for them to take anyway so now I am paying overdraft fees that I did not accumlate because they tried to take mmoney from my account. This is going to stop now and I mean now.

*EDitor's Suggestions on how to get your money back into your bank account that someone wrongfully takes it from you!

EDitor's Suggestions on how to get your money back!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

If you apply for a loan through this company, you ought to try to follow these suggestions:

READ EVERYTHING. Save all documents to computer. Print out or (make a PDF of) the loan application. In the terms and conditions of the loan agreement text box itself, highlight and copy it to Notepad. Then read it.

When filling out the application, please be sure to *uncheck* the check box of the paragraph where it starts "Fraud Protection: Many of the people who apply with us have made their personal information available through applications with other lenders."

This is where you get charged $24.95 for the Fraud Protection through something called the Fortress Network. If you check this box, then you will get charged.

The day after, visit sites like THIS one and do research. Also, try (((Redacted))) anywhere where people have complained.

If, after everything you read, you are alarmed and not sure whether this is right for you... then you can call 877-773-7723, talk to a live person (I talked to Jonathan, who was nice).

In the Notepad text-based "Terms and Conditions," it says this:

"CANCELLATION and PREPAYMENT. You have the right to cancel your obligations by 5:00 PM Mountain Standard Time of the next business day following the Effective Date without having to pay any charges."

So I withdrew my entire application. I also emailedthe company with the following emails:

Dear Sirs:

Since I have completed my loan application, I have visited the (((Redacted))) page about Quick Bucks Direct.

The visit to that web page prompted me to write this email.

I have NOT authorized the $24 Fraud Protection through the Fortress Network. I UNCHECKED THE BOX. I do NOT need the fraud protection.

You - OR ANY OF YOUR AFFILIATES - are NOT AUTHORIZED to withdraw ANY money from my checking account.

Please honor this wish.

If you do attempt to withdraw ANY money, I WILL contact your state's Attorney General, and you will be held in violation of the Fair Credit Reporting Act.

You must respond to this email and SAY that you understand the conditions that I state here for the record. You have 48 hours to respond to this email.

Again, you (or any of your affiliates) will NOT attempt to withdraw any money from my checking account. I have not given my consent.

Let me perfectly clear: All I have consented to is a loan application. I will abide by YOUR terms and conditions as long ---> as long as you abide by MY terms and conditions.

You have been warned.

-- Sincerely,

C

AND

after the call to Jonathan, I sent this:

I read the terms and conditions, and, noting where it says in the loan app, as follows:

"CANCELLATION and PREPAYMENT. You have the right to cancel your obligations by 5:00 PM Mountain Standard Time of the next business day following the Effective Date without having to pay any charges."

Therefore, after a please phone conversation with Jonathan, I have withdrawn my loan application numbered 31068583.

I STILL want no money withdrawn. Thanks, and have a pleasant day.

(I BCC'd both emails to State of Utah Attorney General .)
