Unfortunately NJ isn't that tough on violent crime.The assistant prosecutor explained to me that you cannot be imprisoned for 3rd or 4th degree offenses in NJ,without any priors(WHAT!). The worst he "would" have gotten is probation. Well,the Grand Jury indictment hearing was held on 01/03/2007.The prosecutors office actually eventually put a good case together. Unfortunately,the Grand Jury has decided not to go forward with a formal charge against Richard Porcello for aggravated Assault.Porcello will get off there,but there are several huge civil matters underway right now. The first thing that will happen is a very substantial judgement placed against Porcello by my attorneys.That means no mortgage,ever,no financing for a vehicle until he has satisfied these judgements. This information will become a matter of public record 45 days after the hearing. The indictment was "No Billed",meaning that it will never go before the Grand Jury again

New Jersey is the toughest state on violent crime, same as CT. My neighboor had an agrument with his girlfriend and broke a dish but never layed a hand on her. He was put through the ringer and had many many trips to court. It's hard to believe that this case didn't go further. Was there more to the story?

How can he get away with this?I know someone who went to court in Connecticut just because someone had identified his voice on an answering machine tape making a threat.He pled guilty after the prosecuter in Danbury Ct urged him to do so to avoid a lengthy trial.He not only never hurt anyone but still maintains he didn't do it.He pled guilty after the prosecuter in Danbury assured him he would be convicted.BASED ON A TAPE RECORDING.HE RECEIVED ONE YEAR PROBATION FOR THIS!

I did stop breathing in the parking lot where this incident took place. Emergency personnel had to revive me.Richard Porcello was arrested that evening by Jackson Police.The police report says "indictable".I apoligize for my ocassional type-o's.It's pretty hard to do almost anything with no fingers. Typing certainly falls under this category.
