In June of 2001, we purchased a total of 10 vacation certificates online using Ebay.com "joshsjunk.com". We paid a total of $299.95 and were told it was for 20 R/T airline tickets-$16000 value- free! (2 people per certificate).

We read all FAQ provided and didn't find anything that sounded unreasonable. We have tried to contact the Richey Wholesale company for three different family vacation plans and were unable to receive a response.

Supposedly, our certificates are still valid until January, 2005. We had originally purchase the certificates hoping to help our our parents for their vacation plans during the summer of 2004 but to no avail. We want our money back or be given that which we were told (20 R/T airline tickets, free!) as soon as possible.

Please help us to resolve this problem that has been long-lasting and disappointing. Please make sure no on else will purchase the same problem in the future! Aloha

This is a complicated situation, because you made this purchase a years ago. There is a strong possibility, that Statute of Limitations has expired. All that you can do now is try to collect a refund or receive what you paid for, in the first place. There is a website called www.ebayersthatsuck.com. It is a website where Buyers and Sellers warn eachother about corruption. You could access that site for further research, and options. The membership enrollment is cost free. This is just one option. Now, you possibly purchased this product through an eBay dropzone, which means it is not entirely administrated, and controled by eBay. This makes the situation even more complicated. The transaction was through Richey Wholesale, which accepts and allows networking and selling eBay dropzones. Finally, the actual purchase in of itself was through Joshsjunk.com The owner of this specific site is ultimately the one who is legally held accountable, not eBay or Richey Wholesale. Richey Wholesale is a major massive conglomerate, which allows Sellers access and ownership to free web pages. They provide a set of perks and benefits, in the process of providing this service. There are commitments required, but no one is restricted from becoming a member. This is where the website you purchased from networked. This means eBay and Richey Wholesales Purchasing Agreements have to be considered, along with Joshsjunk.com What made all of this difficult to determine is that the actual network for Richey Wholesales is http://www.swapselltrade.com When you purchase through their sponcered sites, your billing statement will read Richey Wholesales. According to www.liveregistry.com Richey Wholesale IS www.swapselltrade.com. Now, bear with me here because I have some contact information. It is crucial that you utilize this contact information, and try not to take it out of context. The address you provided is accurate, but I'm posting it just to be sure: www.swapselltrade.com Richey Wholesale PO Box 3524 Hillsboro, Oregon, 97123 The Sales Manager is Mr. Jack Crowell. This name could be of use, should you consider placing a Small Claims lawsuit. The description provided in Yahoo Groups is: "www.richeywholesale.com is an Internet based company that specialzes in closeouts, merchandise returns, and overaLL GREAT PRICING (their bold caps not mine). The forum is for all to unite and share whatever is on your mind with request to Internet business." This according to yahoogroups.com You can enroll as a member cost free, and communicate your situation to Richey Whole sale. So much time has gone by, that I don't think this merchant runs the same type of business. These merchants are not legally accountable for this injustice to you; however they might just try to compromise to keep you as a potential customer. eBay might even be the better of the two to create other options for you or offer pointers. I have a part of eBay Bid Member Agreement, "Bids are not retractable except in exceptional circumstances, such as: 'you cannot authenticate the sellers identity; or where the seller does not confirm a purchase in half.com (subdomain?) area of service". This gives me hope, that they might help you, because this merchant is not confirming or validating your specific purchase. You can find more detail about this at the official site: www.ebay.com There is a strong possibility the main branch of Richey Wholesale comes out of China, this is another reason for why it might just be easier to go through ebay. Joshsjunk.com was a sponcered website through them, and they would have more detailed records about their website owners. Last, I am under the impression Joshsjunk.com no longer sells vacation certificates, and has moved on to some other ecommerce activity. Still, this is the merchant you went through so here is the applicable contact information: joshsjunk.com Registrant contact: Joshua Marks 1400 Parkwood Drive, #95 Huntsville, TX, 77320 936-439-9492 Mr. Marks is also your Administrative Contact. Technical Contact: VeriSign, Inc. 1-888-642-9675 Call Verisign they might have even more information, and are very reliable. This is according to www.liveregistry.com. I am unable to find out more info, because there is a registrar-lock. In other words, this person knows how to hide. It is ironic that these are Internet businesses, yet they are difficult to locate, within their own industry. Joshua Marks might not be a direct authority, and you still might try going through ebay to verify and confirm this information. It is possible he's not your guy, but he's the only one recognized connected to this website name, at the time. I suspect these sites have moved on and transformed themselves, since you had dealings with them. Collecting a refund will not be easy, but at least with the names provided, you have someone to serve papers to; should you decide to sue. I have not tried any of this contact information. I know this is all a confusing headache, which is inevitable with eCommerce domains. They're always changing, and reinventing themselves. I might be able to help you more or pinpoint more specific information, if you tell me specifically where these vacation certificates are valid. Is this just in the United States only? China? Mexico? Can you process them through the airline of your choice or only specific ones? Who designed and processed them? Richey Wholesale placed real gold foil on certain types of gift certificates sold to merchants, to resell to consumers. If they are only good for travel in the United States, licensing and bonding might be required, and more contact information would become available. I am so sorry to hit you over the head with all this information, but it's difficult. Hope this helps, and get back to us with more information on the Member Service Agreement of those certificates.
