RK Toyota in Hampton is a division of RK Chevrolet in VA Beach VA. I signed a contract to puchase an SUV but they could not get me financed for my purchase. After getting 22 rejection letters from various finance companies, I told them several times that I wanted to cancel the deal since they could not get me financed and I wanted my car be returned. Each time they told that I would need to talk to the finance manager to make the arrangements. This went on for several weeks.

Finally, I got fed up and told them that I would be in on 12/23 to pick up my car and my deposit. When I got to the dealership, I was told that they didnt know where the car was....SOUND FAMILIAR!!! On 12/26 the called me to come in to the office. They informed me that they had received a "conditional approval". When I turned down the "conditional approval", they advised me that my trade in had been sold. I contacted the company that held the lien on my trade in and was informed that the car had not been sold and that RK was flat out lying. FRAUD!!!

The transaction started on 11/21 and they held me off until right before Christmas. They sprung this "conditional approval" on me when they knew that legal counsel would not be available. I turned down the "conditional approval" offer. That is when they informed me that I would owe them $4200 for the balance between the payoff and the actual cash value. I told them "no deal" and walked out of the dealership. I was distraught and in tears.

The finance manager- Rick Maxino- followed me outside and told me that based on my original contract- they could push the loan through without my approval. That was HARASSMENT. Therefore, I had no choice but to sign but to sign the contract for the "conditional approval". They did payoff my trade in but the payoff date was 12/31!! Which means the car had not been sold until after they harassed me into signing the contract for the "conditional approval"

I have read other reports on this website and the RK Dealership use the "we dont know where your car is" story as a tactic to buy time and find a way to intimidate the customer enough to close the deal.

If there are consumer out there who are willing to participate in a class action law suit or an attorney out there who are willing to take on this company and put a stop to their fraudulent practices

Tom Kline Makes Good on his Promise

My husband and I met personally with Tom Kline as he requested in his rebuttal. And I am so happy that I did!! From the very beginning of the meeting, Mr. Kline expressed his committment to arriving at a satisfactory conclusion to our problem and delivering on his promise to make us "whole". To hear that in person was very reassuring. He listened to the events that transpired during our purchase and only interupted us to ask a few questions as a matter of clarification. He was non-judgemental and allowed us to explain "our side" of the story. So far... so good. That is when he did something that I never ever expected!! Instead launching into a lengthy investigation, and using the old "we'll check into this and get back to you" tatic, he asked us what we felt would be a fair conclusion to our situation- what would it take to us happy when we walked out of the room today. WOW!!! Imagine my suprise!! My husband and I had been so prepared to argue our position, we never discussed what it would take to settle the matter. We had to adjourn the meeting for 15 minutes to come up with something!! We came back and presented a list of actions to Mr. Kine. Almost immediately, he agreed to meet our proposal. I was shocked and relieved. Then he did the unthinkable...He asked us " What extra something can I do to make you really really happy with me and RK?". Now I was SPEECHLESS!! Not only did he agree to our settlement offer, but now he was asking "what else can I do to make you feel extra satisfied?" We were so speechless...we didn't know how to respond or what to ask for!! At that point- I was thinking--Is this a dream? In this day and age, how many businesses do you know who would say - we're going to make you happy...but what else can we do to make you really really happy? To make long story short--At the end of the meeting, we were EXTREMELY satisfied with the outcome. Mr. Kline treated us with respect and dignity and we walked away feeling like RK Chevrolet is truly interested in customer satisfaction. We all know that talk is cheap-- actions speak louder than words. Well Mr. Kline is proof that RK Chevrolet is about action!! For anyone who has a dispute, do yourself a favor...take the time to talk to Tom Kline. He is a honest and straight-forward man and I believe that if you give him the same courtesy, you will not be disappointed.
