I was contacted by Discovery Recovery Solutions in an attempt to collect a debt.  They, stated I have a balance of (including all fees) $2204.42. I tried to make some kind of restitution and cooperate, but was unable to get a word in.  I requested more information and they stated they could not do that due to many prior attempts to contact me.

I do not recall them having done so.  Neither my husband nor I were working and could not have made payments of $75.00 each month.  In my attempts to ask more questions regarding this debt,  their (both Robert and Mary on two separate phone calls) demeanor changed almost instantaneously when I ask them for a chance to speak.  I kept trying to get them to give me information to go on. since it had been several years ago, Thirteen as a matter of fact. 

I believe, that when someone is trying to work with you on collecting a debt (and they haven't hung up on you already) you should be a little more patient and considerate. I even called back so I could try to talk to someone who would let me speak and give me more information. I don't think that should be classified as a refusal.  Will someone please work with me here,  I'm trying to rectify the situtation and make restitution.

This debt is from 2001. When they said that payments stopped.  There were payments of $75.00 a month made every month from 1999-2001.  We did not have jobs and there was noway that we were able to make payments, when we couldn't even pay our rent. We had to move from LA back to TX due to finacial hardship..  Something fishy for sure.  They will not send me any info.

I would start by researching this company for an address.  Send them a letter demanding proof of the debt.

I am not an attorney.  I can only tell you what worked for me with credit card fraud.

Ask for something that says you sign an agreement.  The odds are they have no such thing.  If they do not respond I would file a complaint with the State Attorney General's office of your state.  Argue that you requested proof and they failed to provide it.

 

Now if calls get nasty.  Record them Check with your state laws as to whether you can tape calls.  They probably do it. so should you.

 

Do not be intimidated by their threats.  Pointing the finger and saying you owe a debt.  This means nothing.

Avoid having verbal contact with them only do it in writing.

You can also file complaints with the Federal Trade Commission and the Financial protection bureau (u.s. government agency)

Be very careful. Normally I am the first one to say pay it, but not in this case. Don't rush to pay this one at all. Check your states Statutes of Limitations for debt collections and the restrictions the collectors have when the debt is too old to sue you. Do some research on the debtor boards so you know what to do and how to do it.

There are various credit and debt boards (also called forums) and some have good information and others don't so make sure to double check your information for accuracy across several different boards (forums). It may have been a good thing that the collector didn't allow you a word in edgewise so you didn't make a payment or payment arrangement. Making a payment can restart the debt. Do your homework so you don't make the wrong move on this very, very old debt that may or may not be yours. Good luck.
