On June 27th, 2012, Seth Sonstein aka RubberGash2010, dba RubberGash Motors, sold me a 1985 GMC Sierra Classic/Blazer K5 on Ebay auction #180911570367 in the amount of $1550.

Ad description noted the vehicle as "extremely straight with no dings, dents, or body rust of any kind", also describes the vehicle as "runs, drives, and stops great".

Upon paying for the vehicle in USPS money orders for the amount of $1550, and contracting an auto transporter for the amount of $915, the vehicle was delivered to my home in Texas.

The purchased vehicle has rust in both door jambs/A pillars/roof, also rust hole in right front wheelwell, and right passenger door, as well as rust thru in passenger rear seatbelt bulkhead, and rear tailgate.

This rust is clear and present.  Seth Sonstein is a licensed Oregon DMV car dealer, with an Oregon DMV license # of DA3397, he states that he has sold "100's of vehicles". 

As of today, I have filed an internet crime report on IC3.Gov, as well as mail fraud with the USPS...for payment of vehicle with USPS money orders with Ebay auction # noted on money orders, a complaint with the Orgon DMV, and a complaint with the Oregon Department of Justice.

Seth Sonstein refuses to acknowledge his gross and grievous ad inaccuracies, nor does he choose to work out any compensation for his fraudulent Ebay ad resulting in my purchase and shipment of the rusty vehicle.

Man, you don't acknowledge any consumer realities here.  In 26 years of auto sales, I have discovered people usually have reasons to complain about any purchase, that they make.

You obviously  construed your Ebay ad to represent a clean, straight 1985 Blazer variety, which evidently wasn't the case upon Texas receipt of the vehicle.  You can look at your ad versus the website photos to figure out what the problem is:

You completely misrepresented the vehicle in question, and took a guy for what amounts to $2500, give or take, counting shipping expenses.  In this state, that's illegal.  I would definitely get a visit from a handful of lawyers, if not the local sheriff, and similar.  Frankly I would not put myself in that situation.

My suggestion to you is :  Why don't you offer the guy some partial monies back?  It's obvious that you stand compelled to stand tall in your dishonesty  of this transaction, and refuse to                 work with the guy at all,  but I'm thinking that a nominal amount of cash back, would have made this guy go away.  Is all this worth it?

Again, I would not have put myself, or my business in this situation, but for me, my name and business is worth something.  For  a customer to go out of his way  to launch a website, and spend the time writing letters, making phone calls, and taking pictures...it's just bad business for one to not only refuse to acknowledge your discrepancies in the ad, but to not give the guy money back.

I'm not privy to the full details, but it  sure seems to me, that the new owner of your vehicle wanted to work something out with you.

So, after reading your comment, it appears to me that you believe yourself above reproach. Looked at your original Ebaymotor ad.  You show the vehicle as if its some sort of cream puff.  Great pictures, although limited in detail.  Description, states that the vehicle has no rust of any kind.  

To me, it looks, like you have an extremely nice truck to sell. Then, of course, we go to the gentleman's website showing the detail pictures of the guy's purchase from you.  WOW.  Sure looks different, than your ad dude. So you are a dealer in the state of Oregon too?

Are you completely ignorant, or are you a crooked fella'?  You have no right to state anything in regards to how you think this guy is crazy, or threatening.  How do you think he is supposed to feel?  You sold him a truck, with clear body rust.  $1550 for the truck?  $915 to get it down there!!  

Yeah, man.  I would be pissed off too!  You know full well what you did.  You're an auto dealer, trying to make it out like you were the one wronged.  You have some honesty issues, as well as a crooked sense of business principles.  My hope is you get caught up in the wheels of justice, and some sort of penalty falls upon you.

If the guy, is upset, its clear to me why that would be the case.  But wait a minute!!!  Poor ole' you!  You sold a cream puff, that suddenly erupted rust on its way down to Texas!  RIGHT!!! Anyone near the city of Portland, beware Seth Sonstein, and his dishonest car dealership!! It's too bad the guy doesn't have an easy way to your door step.  You deserve his anger pal, and likely, deserve more than that.  I hope you get a little come uppance, soon enough.

Well, I'm here looking at dealers in Oregon, and came across this post.

Found it interesting the commentary so far. 

Obviously the buyer is upset.  I can't imagine someone putting up a website over a $1550 purchase unless he felt wronged to an extent.  Not exactly easy or cheap to do.

I looked at the Ebay ad.  Definitely says NO BODY RUST. 

The website pictures show both door jambs and roof pillars, the tailgate length, the inner back seat footwell sidewall, front passenger fender and the front passenger wheel well.  I drive a 1990 Chevrolet K5.  Pretty familiar with this.

Why would a licensed car dealer say NO BODY RUST?  

I think the dude that posted got screwed.  Obviously this Seth Sonstein character isn't on the up and up.  Ad detail is ad detail.  He pretty much lied(ad description as a car dealer), and misrepresented the vehicle(website pictures).

I'm not judge or jury, nor know local business law, but you may as well say this Rubber Gash Motors sale is a complete fraud.  You can't operate a business lying, nor misrepresenting your product, without implications,whether  from consumer or state/federal law.

This site used to be about reporting getting ripped off.

Now it appears one posts arguements over how much or how little someone gets ripped.

Every post on here is completely missing two details.  THE original Ebay ad, versus what the guy in Texas received from the purchase.

Yeah.  Seth ripped off James.  Royally.  Classically.  Definitively. Carnally.

I went to the website that you put up and obviously there's rust but it seems that most of the pics are taken of the same areas but just at different angles and closeup shots. So it really gives off that theres a lot more there than there is. I do beleive that they could have worded the listing differently to describe the rust. But this is also a $1500 vehicle and did not exactly just roll off the assembly line. So I would think that a $1500 truck to be a rusted gasshog.

WOW! Amazing! You go on Ebay thinking its a trusted site to buy a car that turns into just a rustbucket from a Company called Rubber Gash which sounds like a bonding porn movie anyways.  My first clue would have been.  If you wake up with an apple in your mouth and your pants around your ankles then you have just been had by the Rubber Gash Man.  Sorry for your luck man

Number 1.  It does not matter how much the vehicle sold for.  My bid was for a higher amount, based on what your original ad stated.  Aforementioned website has a link to the original Ebay ad, with your statement of "no body rust of any kind".

Number 2.  Our follow up conversation on the 28th of June, has you re-stating that the vehicle is clean, with "no rust whatsoever", and that you are a "licensed Oregon car dealer".

Number 3.  Your offer of a full refund, is only upon receipt of your vehicle in Oregon.  Since I already paid $915 to have the vehicle shipped to Texas, a duplicate charge would be paid by me, to get it back to your address.  You have already stated that you will not reimburse, or compensate such a transportaion cost.  So in essence, I will pay $1550 for the vehicle, $1830 for the vehicle to get back to you.  So pay $1830 plus $1550 to get my $1550 back....right.  Don't know what your education is, but that is yet another in the loss column for most accountants, and/or finance guys.

Number 4.  You won't answer your phone.  You won't own up to your dishonesty, present in the pictures available on the same aforementioned website  www.rubbergash-sethsonstein.com  .  Nor will you even offer any difference in my purchase price, and transportation cost, for purchasing your choice rusty 1985 Sierra Classic.

Number 5.  The only thing that comes up on Google, or a skip-trace service, are the addresses provided on your sham Oregon DMV dealer license #DA3397, your physical assault of some theater reviewer, and a purchase of a rainbow unicorn trucker hat.

Having no such recourse possible with you, I turned you into the :  Internet Crime Unit of the FBI, Oregon Department of Justice, Ebaymotors, USPS for mail fraud, Oregon DMV licensing, and the BBB.

The website is easier, and more inexpensive than forwarding unnecessary color photo copies, black and white copies, and photo cd's....unless specifically requested by the named entities.

So yes, Mr Sonstein, I don't need to wait on you anymore, for justice.  Once those parties finish up their appropriate course of actions...I will most definitely be seeing you again. 

I had the intent of purchasing a clean, solid, older Sierra Classic/Blazer.  You had the intent to jettison what amounts to a very rusty, coastal Oregon version of the same model.

In regards to this sale, I have done everything in my power to make things right including offering a full refund.  The buyer has been a crazed Psycho, and has not offered ANY form of resolution. 

Instead he has done the following:  (I have proof of all of these) 

1.  Sent Threatening Emails
2. Made Threatening Phone Calls
3.  Built a Website with my name and information on it accusing me of untrue and outrageous slander
4.  Threatened to report me to multiple government agencies
5. Sent me multiple threatening and mocking text messages.
6. Ruined my 100% Ebay rating with negative feedback.

All of this over a vehicle with a selling price of $1550.

Here is the final email I sent to him that shows my good faith:

I sold you a car that had no visible rust.  You have found rust.  For that I apoligize.  The vehicle was available for inspection during and after the sale.

The vehicle was sold AS IS, WHERE IS.

Also take into account that this is a $1550 vehicle.

That being said, I have tried to work with you on a resolution.  I have even offered a 100% refund if the vehicle is returned in same condition as when it left.

I have also asked you (multiple times) what you wanted as compensation due to the discrepancy in the listing.

You have never told me what you want as far as compensation goes.

Now you have called me leaving a threatening and menacing voicemail, along with your rambling and threatening emails.

You can call all the federal agents you want, and report me to all the state agencies you want, if that is what you feel you must do.

But our email exchanges will show that I have made a good faith effort to resolve this problem in good faith.  You still to this moment have not made any requests for compensation due to the discrepancy in the listing.

So my advice to everyone is this.  If you are selling an inexpensive car or truck, it's probably better to just list it on Craigslist because if you sell it on the internet, you are exposing yourself to people who are truly insane.



The buyer of this truck has made mention that I will be "seeing him soon" which makes me almost feel like it's time to take out a restraining order against him based on his other threats.

Well, as the post says.....Seth Sonstein is a licensed car dealer.  I agree with everything else that you said...sucker born every minute applies to anyone purchasing a vehicle, "sight unseen" from RubberGash Motors or Seth Sonstein.  Thanks for an even better description of the individual that I am discussing!

You decided to throw common sense out the window with this stupid deal of buying a used car, sight unseen on the internet! You set yourself up to be deceived and defrauded. You opened the door to this all by yourself. Plano is a pretty big town. You could have bought a car there, checked it out and have a mechanic check it over for you. But no...throw common sense out the window to send your money off to somebody you don't know to buy a used car you've never laid eyes on. Smart...real, real smart. "A sucker is born every minute!"
