safeway i need help on what to do SAFEWAY IS TRYING TO CHEAT ME chicago, Illinois
i got into a accident with a safeway driver that blew a red light and was intoxicated. it occured on gunnison and austin in chicago on friday 8.20.10.
i was driving west on gunnison crossing the intersection of austin when out of no where a car came speeding at me. the driver of the vehicle blew the red light and hit the back part of my drivers side car. my car spin into a 360 in the intersection and finally came to a stop. the police arrived 15 minutes later along with a few tow trucks. the police made a report but didnt ticket the guy that hit me for blowing a red light! and driving drunk!!!!! the best part was that he came out and told me he doesnt want police because he drank and his breath smelled like straight vodka, but i called anyways. my car was not drivable so i had to get towed....i was towed to "the body shop" somewhere on Western because the tow truck driver told me his insurance will cover everything and that someone will come give me an estimate on the car on monday. i called safeway on saturday (day after the accident) and made a claim.
i waited till monday and called "the body shop" to see if anyone has came to inspect the damages. nobody came. called on tuesday-still nobody came. called wed-still no one came. i then got a letter from safeway that they are not paying for the storage and to get my vehicle out of there, but the thing is "the body shop" told me that he talked to the insurance on monday and that they will pay for it, and that letter was just something they send out to everyone. that was BS, i came to get my car out of there and they charged 498$ for towing !!!! and alittle over 350$ for storage, when in fact it does say on the receipt from the tow truck driver that towing is 150$ and storage is 50$ per day. so how come i got a 498$ towing charge and a 75$ per day storage?. there was no mess on the intersection because my car was still all together and even if it was how did is it 498$ since cleanup is 100$!!!! THE BEST PART IS SAFEWAY WOULDNT PAY FOR ANY OF IT! i said F that and got my car to MY body shop after paying almost 900$. my car was totalled, the back wheel was sideways, the quarterpanel was all bent up and back bumper fell half off and the metal piece behind the bumper was in almost to my trunk. my car is a 2001 mazda 626. i got my car towed again but this time by a friend that only charged 100$ to tow to another one of my friends body shop. finally a week later after the accident on friday a inspector came and said he will give 1300$ to fix it when i just payed 1000$ out of my pocket to get my car out of the storage for an accident that wasnt my fault! 1300 wouldnt cover anything. i was estimated to almost 3000$
oh and RENTAL CAR--They would only cover 25$ of it !!!!!!!! so i was stuck without a car for a week with lost wages because my car is basically my job, i cant work without it-(i deliver)
can someone please give me legal advice in what to do or just advice. thank you
