I have been in the process of refinancing my home with Select Portfolio since April 2005. This has been an ongoing battle since the day they began servicing my loan under the Fairbanks Capital flag and it has just dragged on. I would send payments fed ex, and it would take them 31 days to post it from the day the receieved it.(i have proof of it!) then they actually foreclosed after my attorney sent them proof of payments they never cashed.

I have been doing many things pro se because of all the documentation i have if i were to ever go to court, frankly i couldnt afford to hire a lawyer. i have tried to negotiate out of court without a lawyer and have managed to keep my house so far and finally found a company that will refinance me away from this company. last week i was served with papers and when i read them, they filed judgement of foreclosure. the problem is, they already have a judgement that they were granted several years ago. now i have one judgement and 2nd pending on my response. this is from a different attorney than the one who has been handling this for select. now i will be charged attorney and court fees in two different court actions for the same mortgage for the same house!

I need help. at this point, i want compensation from this company and i need the doctor of juris prudence after a name to keep these people from doing this again and again not just to me but to other consumers.

They changed their company name but problems still exist. Check out the ruling by the Federal Trade Commission back in 2004 which Fairbanks (now Select Portfolio) had specific COURT ORDERED procedures to follow. If you have an attorney, have him look it up immediately.Its entitled "Fairbanks vs. Curry". I am in the process of getting an attorney and if anyone would like to join me in class action let me know. In my case, there are several violations of the settlement agreement and this needs to be brought out in court. also file a complaint with the Federal Trade Commission and the local state attorney general and make sure you mention that this company has violated the FTC ruling that they paid $40 million in fines for.
