Our mortgage loan was transferred over to Seterus for servicing from Bank of America.  We had to suddenly relocate across the country.  We met with a realtor and placed a multiple site listing prior to the move.  We had missed the last two payments with Bank of America due to moving expenses and having to rent a new home.

Our realtor tried to do a showing of the house and discovered the house had been rekeyed.  He was unable to enter.  We complained that Seterus had illegally broken in and entered our property.  They then billed us for the rekey.  Their response was that they have the right to inspect the property and enter if the property seems to be in danger.  They provided an inspection report to us as "evidence" that breaking/entering/rekeying was required.

The inspection contained muliple falsified statements.  One primary falsification was that the house was abandoned because there was no evidence that the house was for sale.  I guess the "For Sale" sign in the yard, as well as the lock box, and the multiple site listing doesn't count.  The report advised the house had no electricity or water.  Both false.  The state of WA doesn't allow the electricity to a home to be cut-off, or changed from your name untiil sold and re-titled.  The water was left connected for the sale showings.  We paid the electric and water bill continously. Lastly, what they claimed to be justification for entering and rekeying was that an out-building's door was partly open and had a broken lock.  This out-building is a separate, empty storage shed, not connected to the house.  It has no electric or water, and never had a lock.  We finally managed to get a key from them to the realtor.  They continued to argue that they had justification for their actions based upon inspection.  Another interesting statement on the inspection report is that our 1/2 acre property had no grass.  I wish we would have known that before we kept paying the mowers.  Seterus also billed us for mowing of our property that had "no grass." 

They took over the mortgage about Dec 23rd.  We made a payment in February and March.  The house was under sales contract in April and closed on May 9th.  Seterus had forwarded to us on behalf of Fannie Mae, a modification offer.  We had made the two payments under the modification offer.  Seterus then revoked the modification because of the proposed sale.  They then stated since the modification wasn't completed, the payments made did not meet the full payments and therefore still counted as late.  Our credit reports ending up having lates reported as 180 days.  Jan, Feb, Mar, Apr and May.  We have tried multiple times to get our credit from them reported correctly.  They will not change it because the modification (that they revoked) wasn't completed.  Thanks to their actions we ended up in a 9.25% mortgage on our new house. 

They also constantly harrasses us via phone and mail.  Since they continued to show our account as late, despite the two payments made under modification offer, they continued to harrass us.  We have been told this is also illegal.
