I am a victim of real estate fraud. I have certified documents, via the City of Plano, that this company remodeled the home it sold to me without permits or inspection, and used unlicensed workers. The remodel covered an established termite infestation. I have a full inspection report from Robert Doran, who is a State Board licensed plumbing examiner, also indicating no inspections were done. The Director of Enforcement at Texas State Board of Plumbing Examiners is reviewing our case. Currently this company plans to foreclose and resell this home to another victim before the State can finish its inspections. This case has found its way to Judge Jill Willis, at the 429th District court in Collin County.


 


Although she lifted the foreclosure Temporary Restraining Order my attorney obtained from another Judge at the 429th, she ordered mediation, however Shadow Oak Holdings still intends to auction the house the first week in July, 2013. I have been advised by William Hoder, FTC Midwest region to pursue filings with Texas State agencies, which I am doing. I am enclosing a link to a Dallas news publication featuring Shadow Oak Holdings, Llc.  Aaron Bell worked on a project under Daniel Duke's supervision in Montana. Daniel asked the manager of the company to remove Aaron from the project due to his bad attitude, failure to comply with instruction, and poor work ethic. Aaron Bell apparently can not navigate a State Licensing Board website. Daniel Duke is currently State licensed as a master plumber in both Texas and Montana. Aaron Bell is engaging in slander and defamation of character and will be reported to the Montana State Board of Plumbing.

 In response to Nesbit and Shadow Oak Holdings. The lie continues. Arbitration found me in good standing and current on the original note. The agreements made during further arbitration included Nesbit paying me 60% of proceeds of $100,000 worth of improvements I made to the house to be paid to me after the sale. I could not in good conscience sell the house personally because of all the disclosures (flooding, mold, prior termite infestation ) necessary for an ethical sale. The house was turned back to Nesbit to sell and sold within 2 weeks after listed. Our attorney contacted Nesbit's attorney for release of proceeds owed to me per signed contract agreement made in arbitration. They refused to release the funds owed to me. Nesbit further falsely accused me of stealing $10,000? Doors, lighting and pool equipment? My wife was a building contractor and the furnishings she installed did not belong to Mr Nesbit and were not part of the sale--and he knows this. A Polaris pool sweep is considered a personal possession, like a lawn mower, but Nesbit believes it is his? All light fixtures and doors were in place at the time of sale. There is no outstanding judgement against me, on the contrary, Nesbit still owes me money from the sale and has illegally pocketed all proceeds.

To set the record straight, yes Shadow Oak Holdings forclosed on a house owned by Daniel Duke For which Shadow Oak. Holdings held the mortgage. The report Mr. Duke filed here is quite inaccurate.  All procedures were followed properly using attorneys and testimony in a court of law.  The ejudication was handed down by the judge in the case.  Mr. Duke was in violation of his mortgage note by over one full year.  Shadow Oak Holdings made every attempt to work out a resolution with Mr. Duke including aligning him with debt planners to work his way out of his financial situation.  He clearly could have qualified for a loan to the fulfil his responsibilities to Shadow Oak Holdings but chose not to do so According to the debt advisor he was using.

After trying to work with Mr. Duke through 1:1 conversations, attorney to attorney conversations and through a 3rd party that was familiar with both sides, Mr. Duke continued to ignore his loan payoff and stopped making payments on his note.  In addition he stopped paying the property taxes.  After over one full year of attempts to rectify the situation and two separate extensions with liberal terms given to Mr Duke Shadow Oak Holdings had no other recourse but to foreclose.  

Mr Duke counter sued and lost.

 To settle accusations made by Mr Duke, some of which he admitted were false while under oath and giving testimony (including under oath stating that he lied when he accused Shadow Oak Holdings of the fraud stated in his ripoff Report) the judge required mediation to settle the remaining issues.  The sides came to a resolution on those issues in mediation (things like what he could take with him on improvements he made to the house, an agreement to sell the house at a price determined by Mr Duke for 30 days and an allowance for Mr Duke to stay in the house for 30 days after the foreclosure at no rent) Mr Duke then proceeded to not honor the terms of the court's decision and to not honor the terms of the mediation agreement.  He then stole the front doors of the house, which he valued at $7500 as well as lighting in the house and pool equipment.  There is an open law suit against Mr. Duke for these actions but he is no where to be found.  The value of the items Mr Duke stole exceeds $10,000.  

Shadow Oak Holdings abided by every letter of every commitment in the Mortgage Note, the court ruling and the subsequent Mediation Agreement.
