I am the President/CEO of Building Capital, Inc. Pablo in Van Nuys levied this complaint on or about 06/28/08 against Shawn Brennan or Brennan Capital Group (exclusively Brennan's company) or Building Capital, Inc. Please be advised that Shawn Brennan is presently employed as a loan officer with Building Capital, Inc. Our company policy is to refer or outsource all credit repair issues to third party vendors. Building Capital, Inc. conducts extensive due diligence in conjunction with our corporate policies and procedures. Building Capital, Inc. does not engage in repairing credit reports. Building Capital, Inc. is a mortgage brokerage. Our loan officers are not authorized to engage in credit repair unless the borrower specifically signs our disclosure (Authorization to Release Information & Credit - Debt Negotiation Disclosure) on a per file basis. Please provide me with additional information that will assist Building Capital, Inc. in contacting the individual who filed the complaint. Upon receipt of the individual contact information, Building Capital will contact the individual immediately to obtain more information and successfully resolve the issue. Building Capital, Inc., at this time, is formally requesting that Report #344827 deletes any reference whatsoever to "Building Capital, Inc.". We are not disputing the individual activities of Shawn Brennan or Brennan Capital Group, which are both completely unrelated to Building Capital, Inc. Thank you.

Mr. D, Based on your public response and in our opinion, slander, I've handed the matter over to our attorney for review. If you would like to resolve this, I've outlined in direct communication to you and via this posting service what we would like to have in place to move forward on your full refund within the interim 60 days. We have sent now 3 rounds of letters on your files and based on your instructions we'll take no further action to assist you. We'll forward copies of our work file to you via registered mail to illustrate work that we have done once you acknowledge that our letters represent intellectual property and may not be duplicated or displayed in a public forum. I take your complaints seriously within the context of what we can actually provide under Federal and State Statues. You seem upset and I'm willing to be responsible for the breakdown in communication around the lack of a master service contract. I also acknowledge that based on the referral I didn't insist on you signing our normal client service contract. Furthermore, internally the file was labeled as "results only" file which we call on after 3 to 6 months when the final results are posted. From our perspective we were discounting our fees as a favor to a known party. Based on a review of the matter, I've identified a few process and policy issues that we've resolved. Again, clearly our business practices weren't as solid as they needed to be and we've taken action to amend our policies to ensure this never happens again. In hind sight I'd rather be receiving accolades for what we have done to assist you rather then allocating resources to defending our businesses. Please note and consider that a large portion of our business is involved with the use of intellectual property. We need to balance the nature of your complaint, the business issue at hand, the damages, the continuous improvement of our businesses and the protection of our business interests. We are happy to work with you to find a mutually agreeable resolution. I'd like to head off any further back and forth posting on this matter and focus on a mutual resolution if that is possible. As we have outlined in prior communication, if you are interested in receiving your full refund you can collect it at the escrow we set up for this purpose. We would like to reestablish meaningful communication to bring about a mutually agreeable resolution. If you would like to escalate this matter to attorney supervised mediation then please let us know how to contact your representation. Although we are willing to continue this open forum, our request is that we resume communication offline directly or by way of our attorneys. He is lying because if he explained on the first time how his service work why I will hire somebody to send letters without be sure if his service work. His note was really kind how he explain everything but nothing is true. Now he is trying to said he will return the money back is not true and what happend with all the calls and emails I send him before without answers. He wait to be in this situation to respond. He threatened me telling me "HE WILL CALL INS (Immigration)" thinking because I'm a hispanic I will forget everything. What about those people how really are scared about the INS. They will forget about the money and let him take the money with a false promises about helping with your credit. I'm and Immigrant and if he calls the INS and the INS will came to my home and send me back to my country, I'll be proud to go back saying the true. I don't know why people have to lie and take your money making promise of help and they don't do nothing to help you. Thank you for the opportunity to respond to this posting. A long time client of mine informed me that this posting had occurred a few days ago. I contacted the person who I believe filed the report, Pablo Duobert of www.dugart.com at (818) 518-4135. When I called him on July 03, 2008 he would not verify if he did or did not file this report. He was very evasive as to this fact. As we spoke he only demanded that we return funds he had given us to send letters on his behalf to the three major credit reporting agencies to verify the accuracy of the reported information for both his and his wife's social security number. I do believe that I have identified the writer of the report as both the Name and the City reference match what we have on record for Mr. Duobert. We where introduced to Mr. Duobert by a local real estate agent and we explained that we could offer a significant discount to our fees, a 2/3 discount, if we were to only send letters on his behalf and inform him of the final results in a 3 to 6 month time frame. We offer this service under the company name of Veritas LLC furthermore this business nor the actions of any of its employees has any connection to Brencap.com, Building Capital, Inc., Brennan Capital Group, Inc. or any other group or legal entity(s). On our call today we further explained the nature of Federal and State laws governing consumer information and credit reporting companies. He seemed increasingly upset that we where not able to remove factual data from his report. To this end, in the interest of client service, we offered Mr. Duobert a full refund on the conditions that: 1. He admit that he indeed filed this report, 2. He would sign a general release, 3. That he either amend his report to reflect our discounts and work provided or have the report removed, and 4. That he would sign our customary client service contract. We have also arranged for the refund to be held by an escrow agent in the event that he is more comfortable dealing directly with a third party to actually receive his refund. As of the time of this writing Mr. Duobert has not been responsive to our movement toward an amicable resolution. He wrote to us: "Brennan, Don't be ridiculous with that statement. I never agree that post was made for me and I don't have to sign for that. The only document agree to sign is I'm not anymore your client. You agree to send the money back now I realize you don't want to do that. I'll be waiting the check and after that we will talk." Our offer and agreement stands as our commitment to resolving this matter regardless of the current difference of opinion of what is right, who is right and my inner feelings that I am being extorted. At the end of the business day I'd like to attract and retain clients who realize value in what we do for them; therefore, I am willing to forgive 100% of our fees and refund Mr. Duobert's deposit once he fulfills on our request for release and acknowledgement outlined in this posting. In the absence of Mr. Duobert's direct response and acknowledgement we will continue as promised with two additional rounds of review on his reports and we will leave our offer of a full refund on the table for 60 days from the date of this posting. In general terms, I feel that we have done what is needed to resolve this matter both quickly and amicably. I am available to anyone who maybe interested in this matter.
