This is a letter to advise that the above company and contact person has fraudulently sent me the wrong shipment of goods and is completely non-responsive after various attempts to contact by email and phone.

I ordered a quantity of 5 200cc chopper motorcycles that were to be shipped to me here in the USA.

 Since March of 2009 I was in communication with Lucy from the company. She assured me various times that she would get me the identical choppers for the price of $765 p/chopper plus shipping. (proforma invoice attached)

In May 28^th of 2009 I engaged in bank and monetary wire transaction.

On May 29^th of 2009 I confirmed the quantity and color selection of the choppers.

On May 29^th of 2009 Lucy of Zhongqi company confirmed that they would send out such choppers.

On July 6^th of 2009 I receive the Bill of Lading stating that 5 motorcycles are on the way to me.

In the month of August, I follow all process to clear the goods from customs and spend over $1,900.00 to clear goods.

On August 21^st, I receive manufacturer certificates and see that the MCOs show cheap quality 50cc Scooters make and model numbers and are not what I order. So, I email Lucy that the certificates are wrong (see below in this email thread) this is what she responded:

This is just Body Type,more are conveniency to export,one Certificate was enough,before can if USA Goverment have new policy now? so clear these goods from customs soon.Regards

Yes,that is Chopper.

What i sent  Certificate  by email and express last time can clear customs.

 list of spare parts our supplier still not give me so need wait.

While clearing the goods there were a few discrepancies in the documents that the Customs House Broker noticed she noticed that their were 3 parties involved:

the manufacturer: Tazishou City Kaitong Motorcycle Manufacture Co:

two other parties: Zhongqi and ZhongMaoDa

 I ask Lucy about this discrepancy and she responds the following:

Zhongqi and ZhongMaoDa are the same company,zhongqi is the branch company of zhongmaoda,so the address is same,so we use ZhongMaoDa,also you need use Zhongmaoda,we are the export co.we bought products from Tazishou City Kaitong Motorcycle Manufacture Co., Ltd,so this company is the direct manufacturer,JMStar Powersports and Taizhou City Kaitong Motorcycle Manufacture are cooperate relations,because every chinese company want to apply EPA Certificate what need a USA register  Co,so Taizhou City Kaitong Motorcycle Manufacture  Co  entrust  JMStar Powersports (USA) to register EPA Certificate ,so  the EPA certificate of Conformity is showing that the certificate was issue to: JMStar Powersports, but the manuacturer is Tazishou City Kaitong Motorcycle Manufacture Co., Ltd,i think this is clear.

When all goods are cleared through customs, I find that the goods that I have received are not what I ordered, so I proceed to contact Zhongqi Company and Lucy unsuccessfully they are non responsive and have completely dropped all communication. I sent numerous emails and made various phone calls. They do not respond. They answered most emails within a day timeframe, once they knew that the shipment was cleared and that a chargeback would be impossible, they dropped all communications.
