I was ripped off by Sigma Software Solutions Point of Sale System also known as Inventek Software.  I purchased one of their systems off eBay last year that was labeled as ‘Manufacturer Refurbished’  and received a ten plus year old ‘Seller Refurbished’ machine.   This is the machine they sent me:

The seller now lists the item as ‘Seller Refurbished’ after I complained. Below is a screenshot from the old listing when I purchased it.  Under condition the product was labeled as ‘Manufacturer Refurbished’ which clearly it was not from the photo of the Dell Tower above.

Here is my correspondence via email where Sigma Software Solutions admitted their ‘mistake’.  If you’re running an eBay business you should know how to list your items.  I’m sure if I didn’t complain to eBay, the POS system would still be labeled as ‘Manufacturer Refurbished’

I complained that the machine was mislabeled and wanted a refund. Sigma Software Solutions responded that they would exchange the computer but not issue a refund. I called Jamie Marulanda at Sigma Software Solutions @ 954-449-6093 to get a refund and was screamed at on the phone that they do not issue refunds. They offered to send another machine which was not received for almost 45 days (I live in Hawaii and he sent it Parcel Post which takes a long time). This machine was broken, it turned on and said ‘Orlando Regional Healthcare’ and had no Point of Sale software installed on it.  It did have information about hospital patients.  I asked for a refund and was told they won’t offer a refund because it was more than 60 days since the original order was placed.

I’m sure they sent the broken computer to me to make sure I was out of the warranty period so they wouldn’t refund me and both eBay and Paypal wouldn’t issue me a refund.

I sent the machine back to Sigma Software Solutions and am told they did not receive my machine. The post office confirms it was delivered to this address: 5405 NW 102 Ave Bay #208 in Sunrise, FL 33351. I’ve spoken numerous times by email and phone to Jamie Marulanda at Sigma Software Solutions who keeps claiming they never received it and there’s nothing he can do.

The seller misrepresented the product on eBay, replaced it with a broken machine, and refused to issue a refund. He also says it is a BBB accredited business on his eBay ad. 

I looked up his business in the BBB directory and found that it is not accredited. http://www.bbb.org/south-east-florida/business-reviews/point-of-sale-systems/sigma-software-solutions-in-sunrise-fl-90061512 . But, in his eBay ad Sigma Software Solutions has the BBB accredited image which is just plain fraudulent.

I just want a refund for this system that was mislabeled as ‘Manufacturer Refurbished’.  The seller is a thief and I suggest that if you are in the POS market that you avoid Sigma Software Solutions like the plague.  They are a SCAM!

My attorney is in the process of retrieving my money back.   They seem to be skilled at dodging services.

Given the false nature of the claims stated, I will spend the time to ensure that the truth is told so that readers can understand that just because someone writes a bad review, does not make it true. Many times, objectivity is lost by the emotions of an individual. This is amplified by the fact that most people do not want to take accountability for their own mistakes.

Patricia Brissett purchased an Entry Level Point of Sale system for 399.99 from our Ebay store. This system is a low margin – high rotation item that we sell to provide small businesses with the opportunity to use technology as a tool for decision making. It is low priced and the computers and monitors that we use are refurbished. Therefore, scratches and blemishes that DO NOT have an effect on the operation of the machine are common.

On 11/12/2013, we received the sale. We promptly shipped. On 11/21 of the same year, Patricia placed positive feedback indicating that the system worked great. See the feedback below:

Shortly thereafter, the customer called and complained that the computer was too scratched up and wanted another machine. She also mentioned that we stated that our listing said it was Manufacturer Refurnished. This is in fact the case and we DO hold the right to state that the POINT OF SALE system is Manufacturer Refurbished as we are the manufacturers of the Point of Sale Software System and require the need to re-key licenses and components on the refurbishing process. Nevertheless, the idea was to make the customer happy so I acknowledged that she may have confused a manufacturer refurbished Point of Sale System with a manufacturer refurbished computer, which is not the same thing. I edited my listed to avoid any future confusion although I maintain that I do have a legal right to call it manufacturer refurbished because we manufacture the system as a whole, not necessarily individual components.

We sent her a replacement computer and I provided pictures of that computer prior to sending it to ensure that she would be happy with it visually. She approved it and we sent the system out. Funny how she did not mention this in her complaint nor posted the pictures of that machine. She received the machine and used it for a while. Once her warranty and return period expired, she wanted to return the system. At this point, I did not grant the return as her warranty and return period clearly expired. Take into account that both were extended upon the replacement being sent. However, she still went over said period.

She then attempted to place a credit card dispute with her credit card company, Ebay and with PayPal. Both asked me for all pertinent information and SHE LOST ALL CLAIMS. This is because all the fore mentioned are objective parties that take into account the entirety of the information before making a concluding judgment. Note that credit card companies almost always defend the Buyers. Her claim was so off-base that even the credit card company did not back her up.

She then claims that she sent the merchandise back. She did not insure the package nor pay the extra dollar for signature confirmation. Although she claims that we received it, we in fact never received the merchandise back. However, she still wanted us to return her funds. Out of principal and because of how abusive she was to me and my employees, we will not refund anything. How can I refund monies for merchandise that was never received, past the return period, and not issued a return authorization? When I asked her for proof of delivery, she said she would have a signed affidavit sent by the United States Postal Service (USPS), which we never received. We told her that she needed to process a claim with USPS if the case was that she did in fact sent it.

After fifteen years in business, Patricia Bissett has been the most irrational, verbally abusive, and irresponsible customer that I have ever had to deal with. Her lack of accountability on not insuring a package to save a few dollars caused most of this issue. We cannot be held accountable for merchandise that is never received. It is the customer’s responsibility to ensure that we receive the packaged and customers are warned of this when returning items.

The fact is that we have a very good reputation. If you look at our history, our track record speaks for itself. It is VERY difficult for sellers to maintain high compliancy and high positive feedback on complex items such as point of sale systems. However, year in and year out, we continue to do so. If I were in fact a thief as falsely claimed, there is NO way that I would have such a great record. More complaints and more issues would be filed if this was the case. This is just an isolated case of a disgruntled customer with a lack of responsibility and accountability for her own actions.
