In December 2006 I bought a policy that would help cover the cost of my pregnancy since I was uninsired when I found out. After I bought the plan I soon found out that I was approved for Medicaid. As soon as I found out I called Smart Choice to cancel only two weeks after I bought the plan. I spoke with a women on the phone when I canceled, I asked her if there was anything else that I needed to do and she advised me that, that was it and that she would send all my information to the acounting department and that I would recieve a refund as soon as they reviewed my information.

I asked the lady to make sure that they did not charge my account again as they did when I first signed up they just drafted it out of my account. She assured me that they wouldnt because I had canceled.

I called once again days before the $209.95 was supposed to be taken out of my account. Again they assured me that it wouldn't. To my surprise just days later they took the money out of my account and I was overdrafted. I called and they said that there was nothing that they could do at that moment and that they would have to pass it along to a manager. They fully excepted responsibility when they told me that they would take care of this.

As time went on I spoke with a manager named Stephanie, She told me that she would take care of everything and then call me back. She said this 2 other times and I was always the one to call back. soon after the 3rd time I wasn't even able to contact her anymore. So I reported the company to the Better Business Bureau. They then contacted somone within the company, that man's name is Stu Reben. He then contacted me and harrased me as to why I had contacted the BBB. He was very insensitive to me and my situation. After all was said and done he said that he would take care of it. Back and forth with the BBB Stu Reben said that first "Cynthia is not entitled to any refund" But then goes on to say that he was not responsible for getting me the money back. Yet he was bold enough to make that statment that I wasn't entitled to any money back. He then placed the blame on NAPE.

I contacted NAPE and they said that they did not even assosiate with them anymore and that they were not responsible. I then got a letter from NAPE that said that Smart Choice was misrepresenting NAPE as insurance and that IMC was not gettting enrollment material to members ect ect. They then went on to say that NAPE deposited $180,000 for member refunds and paid for and provided benifits on behalf of members enrolled in the plan. So I called NAPE again to ask then what this ment. They told me that my check was in the mail and should be there in about a week. After a week I called again and the number was disconected.

I called Smart CHoice back and they said that that letter was false and that there was no money deposited and they advised me to call my Attorney General. So I did. Its being reviewed now. But in the mean time I recieved a letter from a Life Insurance company stating that they had reason to beleive that someone had forged my information and signature on a policy. I reviewed the material that they sent me and sure enough it was NAPE!! They said that I had been employed with then for almost 2 years and that I was a computer Oper. I have never even heard of this company untill all this started happening. I called the life insurance company to find out how this could have happend and what they were doing about it. Aparently I am not the only one with this particular problem! They said that I should even change my account information all together because NAPE changes there name to get money from the account when the name NAPE is blocked from it, wich I had done.

Currently there is no contact information for NAPE, and my attorney General said that it looks like they just went off the map. So im just trying to figure out now,Who is responsible?

#2UPDATE EX-employee responds

I am a former employee of a company affiliated with SmartChoice. I worked in the Customer Service Dept. where we handled these calls and were repeatedly told that the victims were going to get their refund but it never happened. I have submitted several names and phone numbers to various agencies and authorities. I don't know if anything is being done or not. I have original evidence in my possession and am very disturbed and upset that people rip others off and get away with it. After speaking with hundreds of these victims I was stressed out listening to their stories about how their accounts were drafted several times even after cancelling with this bogus company, being lied to and cancelling major health insurance to only find out that they were not insured at all after signing up with SmartChoice.
