This is the 2nd letter I have written on this topic. Sprint said that we re-newed our phone contract for (2) years. I contacted Sprint several times asking for a copy of the contract, once they sent me to Pembroke Pines Florida to talk to Omar. Omar said he had no records in the computer and no documentation in our file.

Sprint wants to charge me a 150.00 cancellation fee for changing my phone service while under contract. It has been over a year and they have failed to honor my request to obtain this written contract.

History

Our Sprint phone was failing and Sprint did not want to help us unless we signed up for a 2 year contract. We did not want to do that since phone rated were dropping and Sprint was not being competive enough. We went to Radio Shack in Hollywood Florida and found a good plan with T-mobile.

We contacted sprint customer service from Radio Shack in Hollywood Florida to obtain answers to the following (2) questions.

(1) Are we still under contract: reply No!

(2) Could we keep our same phone number should we switch to

another provider: Reply yes!

Sprint Customer service has done nothing to rectify my concerns and has had there collection company contact me several times a day harassing me. I explained to the collection agency what was happening and they said to contact Sprint. Well you can see how far that went. I am for a class action law suit for fraudulent business practices and harassment. Please contact me to discuss further

The burden of proof remains on Sprint

The burden of proof is on sprint to prove that you signed a two year agreement. Write the collection agency a signed, dated letter saying that you wish to file a dispute, and are requesting proof of debt. Be sure to make a copy of the signed letter before you send it, and send it via USPS Registered mail, and place the registered mail reciept with the copy. This forces them to sign upon receipt, and provides proof that they recieved it on a certain date. Once you do that, they can not contact you again until they provide you with proof, in this case the proof would be the signed contract. Once you do this, you will probably never hear from the collection agency or sprint again.
