In May 2017, my car was T-boned by a State Farm insured driver causing damage of two doors, B-pillar and the frame. After repairs, I had my car appraised by Texas Auto Appraisers Group. They calculated that my car suffered $1,800 diminished value from the accident. I submitted the report to State Farm. But the agent (Steve Raleigh) and his manager (Dave Stanesic) plainly said State Farm does not recognize there is diminished value because my car was repaired. They do not want to discuss about it.

State Farm's opinion is clearly wrong because the value of my car did suffer a significant loss comparing pre- and post-accident value, even though it was repaired. I believe they are ignoring the law and deliberately rip-off consumers by not compensating them fairly. They are unethical and clearly do not want to take responsibility of the damages that were caused by the people they insure.

It would be wise for you to request information on the number of third-party automobile diminished value claims that State Farm has paid to date in the state of Texas. This advice is provided because our appraisal company has no records of any of our clients having their diminished value claims denied by State Farm in Texas. Every large insurance company tends to make very low offers but if you've provided State Farm with a comprehensive diminished value appraisal, preferably one that is not computer generated - based on a formula or algorithm, there shouldn't be any grounds for them to deny your claim. When it comes to diminished value claims in Texas or anywhere else, consumers need to be proactive in order to receive fair claim settlements. If your appraiser used a methodology that proved the loss in value such as auction results or the opinions of multiple sales managers at recognized dealerships, persistence will get you results. FYI, with the structural damage you described, your car has lost approximately 40% of it's trade-in value prior to the accident.
