Tell us has your experience with this business or person been good? What's this?

No charges have been filed against me yet, but I did break the law and I was/am looking for an attorney to contact the Investigating Officer and begin negotiations in my best interest before charges are filed. I met with Mr. Eversole and discussed plea bargain, probation, and restitution. I am an intelligent person with an adequate vocabulary and I know I made myself very clear up front about getting this issue resolved.  I paid $1000 as a retainer. During the time span of three months, two billable attorneys (Mr. Eversole and James Fancher) were not able to contact an Investigator in the Sheriff’s department in order to make an appointment to interview me and for them to start negotiations.

I understood from the contract I signed that my case could be assigned to another attorney within the firm and that was not a problem. However, Mr. Fancher was never introduced, nor was his role in my case ever defined. He was just added to the process, and it became double billing for Eversole Law Firm because of the three way communication. A bit of overkill as well as being highly unethical. There was never any constructive work done on my case, but I had two billable attorneys working on it.

In the three months, I sent two short emails inquiring about the status of the case and their replies were “Called the Inv. Left a message. Waiting for reply.”I finally called the Investigator (did not have any problems getting through) and found out that Mr. Eversole and Mr. Fancher had been lying about their efforts to contact her. In fact, I have caught them in several lies. I sent an email terminating their services and requesting an invoice and the return of the unearned portion of my $1000 retainer.

I received an invoice for $1, 221.00. $213.50 of the charges were dated as performed after I had terminated their services. Since I received the first invoice, I have received a second invoice with an additional charge of a meeting between the two of them. They were probably discussing my letter of complaint to them.

And a miracle in that ten days after I terminated their services, they finally got in touch with the Investigator. There were many entries on the invoice that were totally fabricated. After I sent a letter to complain, I received a malicious letter from Mr. Eversole in which he stated they had tried to call me about this matter. This was also told to me by Mr. Fancher who said he had tried to call me on several occasions. (These boys just do seem to have problems making phone calls).

I informed Mr. Fancher that my cell phone plan is with AT&T and on my bill each month, there is a listing of ALL telephone calls I make and that I receive. I have gone through and accounted for every phone call and neither Mr. Eversole nor Mr. Fancher has dialed my telephone number.

If they had performed the services I asked for, $1200 would have been money well spent. Both Mr. Eversole and Mr. Fancher are liars and thieves. And both are just so arrogant about not even attempting to do the work that they were contracted to do, and being so flagrant about flaunting it in their invoice. All I can say is, it is not smart to piss on my leg and then try to convince me it is raining. These guys are a very special kind of stupid.

First of all, if the police are investigating you, then you obviously have more serious issues than you are willing to admit to. To have someone call an attorney a liar when the person, themself, is being investigated for illegal activity is laughable.  You should focus more on getting your life straight, NOT having run ins with the police and then you wouldn't have to have someone call to track down an elusive investigator on your behalf.

Secondly, I would imagine there is more to your history than just this mere run-in.  Criminals or those with criminal like behavior, tend to get angry or frustrated with everyone except themself.  You don't accept responsibility for your own actions (or lack thereof) and you want to harp on the attorneys and pass the blame to them.  Get your life straight.
