StoresOnline, puts on a sales a seminar in which it makes deceptive claims avout its prduct. The product, a package of computer software and advice on building a web site, is represented has having unique featurese. However, the product that the company delivered was not the product that was represented in the sales seminar.
For example, StoresOnline stated that their store building package includes a CD-ROM with proprietary software that allows a person to quickly and easily design a unique Internet page. During the seminar, the presenter specifically said that a user could design unique pages, not select from a choice of "cookie-cutter" web pages. The reality is that the software is by no means unique or proprietary, it is common software freely available on the Internet. And when the user wants to build a web page, he is presented with a choice of standard cookie-cutter web pages.
Another example is the coaching promised during the seminar. During the sales presentation, StoresOnline makes an explicit promise of one-on-one coaching. This coaching is represented as being included in the purchase price of the store-builder package. However, when a buyer gets the opportunity to review the package of written material (called the "Getting Started Packet"), he finds no mention of free coaching.
StoresOnline does not allow an opportunity to inspect the product before delivery. The presentation indicates that "in order to move things along as quickly as possible," buyers would have to wait until the end of the day to receive their store-building packages. This practice allows the buyer no way to evaluate the product until after the purchase contract is signed.
