Working with Stubhub is a nightmare!!!

I went online to sell my Session 1 & 2 Tickets for the NCAA South Regional Tournament here in Houston, Texas.  This is a 2 Day Event and I had tickets for 2 Seats for both Session 1(Sweet 16-March 26) & Session 2(Elite 8-March 28).  The 2 seats were side by side in Section 128, Row 1 at this event. These seats were in the Risers section and on the floor of the stadium, Great View, and just to the left of center court.

Stubhub walks you through the process of creating the information needed to generate a listing on there website.  I followed there steps to create the listing.

First they asked:  What Category are you selling in?  So in the drop down box of selections provided by Stubhub, I chose the following:

--Sports Tickets
--Basketball Tickets
--NCAA Basketball Tickets
--2010 Tournament Tickets
--NCAA Regional - Sweet 16 Tickets and Elite 8 Tickets
--NCAA Tournament Houston South Regional Tickets

After  choosing the categories above, the system generated an event for me to Select: NCAA South Regional Tickets - Strip (Includes both Semifinals and the Final)

NOTE: I had Session 1(Semifinal) & Session 2(Final) Tickets so I believed that I was selecting the right box. Furthermore, I placed the listing for these tickets Sunday March 21, 2010, and this was the only selection they had available to choose at the time.

Stubhub than asks specifically how many seats you are selling:  Obviously I picked 4, since I had tickets for 2 seats for 2 days.

Stubhub than asks the following:

Tell us about your tickets:
-Section
-Row
-Seats
-Splits: 1, 2, 3, 4
(Set a "split" if you want to sell your tickets to multiple buyers a few at a time. For example, if you have 4 tickets and set the splits to 2, buyers may purchase either 2 or 4. If 2 are bought, the remaining 2 will remain for sale)

--Information Provided by Stub Hub

I filled in the appropriate information,
The section (128)
Row(1)
Seats( 9 , 10)

Since I had 4 Tickets, I went with the suggestion of Stubhub to split the 4 tickets into 2.  Essentially, A buyer could buy the 2 tickets for Session 1(Sweet 16) or Session 2(Elite 8), or buy both Sessions( all 4 Tickets).

Stubhub also asks you to leave comments in regards to the tickets.  In this column, I entered a description for these tickets (Session 1 & 2 Tickets, Section 128 Row 1 Seats 9 and 10).

After selecting how you would like to receive your payment for the tickets.  Stubhub gives you a suggested price for the tickets.  However, I entered a price of $320.00 for the tickets.  The system generated a total selling price of $1280 ($320 X 4).

At this time, the listing is complete.  Stubhub shows you there commision ($200 plus) and you hit submit.

I logged out of my account and went to search for Houston South Regional Tickets, and my listing showed up.  At this point, I think everything is perfect.  The split up the 4 tickets into 2 as planned.

Session 1(Sweet 16) $640 Listing Price

Session 2(Elite 8). $640 Listing Price

As mention above, I listed my NCAA Tournament Tickets for sale on 03/21/2010.  They were supposedly purchased later that evening.  I confirmed the sale the next moring and put the 4 tickets in the fedex envelope and attached the pre-printed fedex shipping label as instructed.  Fedex picked up the package and shipped it the same day (03/22/2010).  The buyers received the package on 03/23/2010.

I was contacted by StubHub representatives who claimed the order was fraudulent. The buyer claimed there were to receive 8 tickets for both days.  I explained to them for over an hour that we never had 8 tickets and never listed 8 tickets for this event.  They claimed that the buyer was under the impression they were buying a group of 4 tickets for each day. After countless calls back and forth on this matter, Stub Hub would not budge.  They stated that the listing was for a package of 4 for both Session 1 & 2!!!!! Also, they mentioned they could fine me for the transaction, yet instead they would compromise by given me $500 bucks, instead of the full listing amount.  This is robbery!!!! We followed all the steps as listed above, we sent the tickets in a timely fashion, and yet there trying to screw us me out of money. At this time, It is impossible to purchase 4 Tickets(4 Seats) for both days of the South Regional for only $1200 total price.  These seats were on Row 1 of Section 128, Seats 9 & 10!!!!  Also within the description I provided for any potential buyer, it stated that the tickets were for Seats 9 & 10.   I tried everything possible to salvage this deal.  My son called them to try to intervene as well.  I even asked for the tickets to be sent back, if the buyer assumed there were getting 8 Tickets, they should just send it back.  I am in total disbelief with this issue.  I don't see how the buyer or Stubhub could think that 8 Tickets were to be sold in this transaction. Stubhub has just ripped me off and they dont care.  I was just scammed out of roughly $500 additional dollars that I would received, due to their lies!!!!!

Dear Tony,

This is Jeffrey from StubHub Executive Customer Care.  We spoke yesterday and I wanted to follow up again as it seems you have some additional concerns regarding your StubHub ticket listings for the NCAA South Tournament.

After reviewing the ticket listings together, we agreed that the tickets you sold had been mis-listed at the time of being posted on StubHub with regard to both the pricing and the quantity of the tickets being incorrect. Normally in this type of situation, if a seller is unable to provide the exact tickets listed and sold, then per the StubHub Fan Protect Guarantee, comparable replacement tickets will be located and provided to the buyer to ensure their entry into the event.  As you had confirmed the orders in question, then per the StubHub Fan Protect and User Agreement, you became financially liable for the tickets sold.  Section 4.3 of the User Agreement states: Seller Responsibility. Once a Seller confirms a purchase of tickets from a Buyer, Seller is responsible for fulfilling the order with the exact tickets that the Seller listed. The Seller will be charged a replacement fee if Seller lists tickets for sale and is unable to produce the exact tickets the Seller listed. The replacement fee will depend on how much it costs us to purchase comparable or better replacement tickets for the Buyer. StubHub is not responsible for any errors made by the Seller in the listing or pricing of tickets and is not liable for any such errors.

That said, we certainly recognized that the circumstances of the situation were unfortunate and no doubt upsetting for both you the ticket seller and also the buyer.  We opted to find replacement tickets for the buyer which ultimately cancelled out the orders you sold.   The buyer is also currently in the process of shipping the tickets you sent back to you.  As an exception to our Fan Protect and User Agreement, we worked to mitigate your responsibility towards any difference in cost for the replacement tickets we provided to the buyer.  We had wished to come to an amicable resolution for all parties involved however regret hearing that you may still be disappointed in the outcome of the orders.

I would like the opportunity to further discuss this matter with you and address any additional concerns that you may have, please contact me  directly at your earliest convenience at [email protected].

Sincerely,

Jeffrey Kline
