Kimberly Hart sells Icelandic horses. This is a story about how she sells them, not once, but twice, and pockets all the money.
A woman, Barbara Drosman, bought an Icelandic horse from Kimberly in 2007 for $12,500. There were conditions set around the sale. Barbara wanted a horse that was in good health, had a calm disposition, and which was suitable for a beginner rider. Kimberly sold the horse with that understanding, and Barbara was told that if the horse was too much for her to handle, that Kimberly would take it back and give her a full refund.
Barbara soon saw that the horse was, indeed, too much for her to handle, not suitable for a beginner rider, and not in good health. She returned the horse to Kimberly, which Kimberly accepted. However, the refund was not forthcoming. Barbara waited to be repaid. In the meantime, Kimberly sold the horse a second time. Barbara still waited for her refund.
And she's waiting, still.
Barbara has not yet been paid her refund, as promised by Kimberly. This happened five years ago - in 2007. And after trying for years to obtain her refund, Barbara has had to resort to filing a suit against Kimberly, which she did at the end of 2011. The suit she filed against Kimberly Hart and her business entity, Sunland Ranch, was for breach of contract/warranty to try to recover the money from Kimberly. Barbara continues to wait.
