Current bill from T-Mobile says that I will be charged an addition $1.50 a month to have a "paper bill" sent to me in the mail.  Told by service rep from T-Mobile they can charge me fees like this per FCC.  T-Mobile wishes to go paperless and if I wish to get a paper bill I must pay them for it.                                                                                   



I have one year left on my contract and believe that since they, T-Mobile, changed the contract language by requiring the addition fee for a paper bill they have altered my contract.  I believe that I do not have to honor my agreement or be penalized for ending it early.  I have filed a complaint form against T-Mobile with the FCC asking for a decision on the "penalty" which T-Mobile says I must pay for ending my contract early.             



My contention is that they altered my contract and they changed the terms of my agreement therefore I will owe them no termination fee.

You can still recieve a summary bill instead of a detailed bill for free but ti will not give a listing of all calls /texts made.recieved.Unfortunately T-mobile did go to extreme lengths to let everyone know that they were changing to paperless billing from june of last year all the way until i believe december of last year. Printed notices and reminders were sent with the bills to let you know about the change along with instructions to go online or call 611 to make sure you kept free detailed billing. The problem stems from the fact that you are getting a full rundown of all calls/texts and for some people that goes into the thousands which results in extremely large bills in the hundreds of pages. It would cost extreme ammounts of money to continue sending the summaries to every customer. The company took the only plausible route in the situation and changed everyone over.Im sorry that this happened to you the way it did. On the upside. If call logs arent important to you you can always just change to free summary billing.

I agree with this. I believe that section 5 covers the termination of service with no cancellation fee in this case. If *everyone* had the use of a computer to get the bill electronically, that might be different, but T-Mobile just doesn't care. They want to get everyone to go paperless as a convenience to them and if they don't, they are going to charge a fee for it.

Trust me folks, this is either going to be stopped by the Washington State AG or if not, there will be a class action law suit soon. I don't believe they will be allowed to get away with it.

The plan is for an emergency use only.  60 minutes a month at $19.99.  Nothing more nothing less.  Seems that you wish to pay what you wish while I can not see paying for an addition month, a few dollars short of another month, for the next year.  I have had T-Mobile for over 5 years, switched from Verizon, and other than terrible "bars" in my house I have been content.  May not be a big deal to you but as a retiree pennies count in my house.  I have read their contract terms concerning fees which they collect as allowed and they do not tell you what the use them for normally.  This time I feel mad because nothing has improved for reception at my home but my bill went up .

I think you're a bit of an idiot to 1)get all apoplectic about a stupid $1.50 fee that, as Ashley pointed out, they have the right to change at their whim, and 2) I find it odd that you haven't made mention of any attempts to "opt out" of paper billing which a lot of companies now encourage, and the fee is an incentive to get consumers to do just that.

With my service, paper billing is actually an "opt in" service, which is fine, I suppose, if you actually need to provide paper hardcopies for maybe taxation purposes, but if I wanted a paper bill, I'd have to pay $4/mo. Who in their right mind is going to say "SIGN ME UP!"? Not me. I can access all my billings, in detail, with pretty colors for the last 13 months if need be online for free, and print them off if needed.

Have you even tried to see if there's an opt out on that?

The "out" you are looking for is in their terms.  Ashley was nice enough to post an excerpt that actually helps you.

one-year Term), WE WILL PROVIDE YOU WITH AT LEAST 30 DAYS NOTICE AND
YOU MAY TERMINATE YOUR SERVICE WITHOUT AN EARLY TERMINATION FEE (WHICH
IS YOUR ONLY REMEDY) BY NOTIFYING US WITHIN 30 DAYS AFTER YOU RECEIVE
THE NOTICE. IF YOU FAIL TO TERMINATE WITHIN THOSE 30 DAYS, YOU ACCEPT

Increasing your "set monthly recurring charges" by $1.50 is certainly adverse to you.  I would send them a certified, return receipt requested letter that clearly states to them that you consider this to be an adverse change to you and that it increases your monthly recurring charges and as such you wish to excersize your right to terminate the service without an early termination fee.

Kindly post their response to your termination letter.  It should be interesting.

Also, you should file a written complaint with the FTC (NOT the FCC) and your state attorney general.  The FCC DOES NOT process billing/contract disputes for consumers.  This is clearly stated on the FCC website.

Sorry you have no legal ground to get out of your contract for this $1.50 fee:

As you can see they have the right to make changes to your bill. You agreed that they had this right, and they are exercising it. They have to let you out of the contract for a RATE change, but not for: "overage, features, optional services, taxes and fees"

Since this is covered under "fees" they have the legal right to hold you to your contract. Especially if you wish to avoid the fee you simply have to go paperless.

The FCC will not help you in this case, this is more of an FTC complaint. Problem is, you signed a contract agreeing that they could do this.

Yes these companies seem to like to jump on the "green" band-wagon using it as a reason to charge you more fees.  However, you trying to get out of the Early Termination Fees probably won't work.  Eventhough it may not be a method you prefer, they are still giving you the ability to get your statement for no additional cost.  

You would have to look in the agreement.  If the agreement states that they guarantee you paper statements for no additional cost, then you probably have a good case.  But I seriously doubt that language is in the contract.  So, if there was nothing "altered" you are not going to get out of the termination fees.
