T-Mobile ripped me off for $100.00. I sent the following letter to their legal department and consumer relations only to be ignored. I am complaining to the FCC and Public Service Commission now. Their defective phone stopped working after a month, customer service said it was covered under warranty and to send it back. Then I get a $100.00 charge on my bill which they will not remove. I disputed the charge and asked for arbitration as stated in the contract, but they cut my service until I paid the charge. Their customer service is horrendous, illogical, and rude. Pick a different provider or you will be sorry like me. Trust me, I'll get my $100.00 back.

I hereby dispute the $100.00 charge on page eight, described as One Time Charge for Out of Warranty, on the T-Mobile billing statement dated June 17, 2008, for account number xxxxxxxxx. I request that you remove this charge and any associated late fees from my account balance immediately based on the following explanation.

The Samsung phone for number (xxx) xxx-xxxx suddenly stopped working for no apparent reason as it was never exposed to physical or liquid damage. The display screen worked, but would not respond to any keypad actions. The display was frozen on one screen. A call to T-Mobile for technical help did not solve the problem. The T-Mobile technician asked about the display, had me remove the battery to check for water damage on the indicator strip, and stated that the phone would be covered under warranty. The phone was replaced under your warranty guidelines but much to my chagrin, T-Mobile has stated that the phone was not covered under warranty for no specific reason. Documented calls to the T-Mobile help center provided the following reasons for non-coverage: The display was cracked, There was liquid damage, There was physical damage, Liquid damage is physical damage. I was denied a request to have my old defective phone returned. Obviously, no one at T-Mobile knows why the phone was not covered, but thankfully before I returned the defective phone, I had the premonition to take pictures of the phone from all angles including with the battery removed showing the moisture indicator and serial number. The warranty denial is fraudulent and I can prove it.

If the above explanation does not persuade you to drop the Out of Warranty charge, I hereby request mandatory and binding arbitration of this dispute as required under the contractual obligations of the Service Agreement between T-Mobile and My Name signed on March 21, 2008. The above mentioned photographs of the defective phone, a comprehensive list of documented phone calls to the T-Mobile service center, and this and any subsequent letters will be submitted to the arbitrator.

Failure of T-Mobile to honor my request to drop the Out of Warranty charge combined with a refusal of mandatory arbitration will be considered a gross breach of contract by T-Mobile and the Service Agreement could therefore be declared null and void by me.

Hopefully this matter can be resolved promptly before the next billing cycle occurs. It is my desire to maintain a fair and reasonable customer relation with T-Mobile.

I just ran across an IDENTICAL issue with T-Mobile. The rep had me go through and check the water sensors and I was told it would be replaced under warranty. I received my latest bill and there is a $100 charge for Out of Warranty Replacement. I called to ask what was about and I was told that there was liquid damage. Apparently 'the warehouse' dismantled the phone, and there are additional sensors inside the phone that said there was water damage. The only water this phone has seen is while it was in my pocket and raining. I told them that, and they said that was enough to activate the sensor. It's completely unreasonable to expect that a phone will never see rain! I also think it's deceptive that they have you check sensors, then they check some secret sensors that only 'the warehouse' sees and they make the final call, and of course the phone is 'thrown away' once it's been determined unusable so you'll never see proof. I'd be interested in knowing how things go with your dispute, If all goes well I may need to follow the same steps.
