 I received a call from T-mobile at 11:25pm eastern standard time and a voicemail was left. Saying something about an upgrade. This is a definite violation of the FDCPA Regulations. I will be contacting a lawyer about this matter. Companies aren't supposed to call past 9 pm. This is well over 9 pm.

Sometimes in reading these "RipOff's" you wonder where in the world these people come up with their thoughts.  So I do have to say thank you for one of the bigger laughs I have gotten from these reports recently.

First off the FDCPA has to do with Debt Collection, so unless you are delinquent in your phone bill this has nothing to do with your case.  Second, the FDCPA also only applies to 3rd party collection agencies.  Even if you did have a debt T-Mobile is considred an Original Creditor and the FDCPA does not apply to them.    Something tells me that you aren't exactly a stranger to having debt collectors calls you.

So, when you go see your lawyer if they try to get you to pay a retainer up front telling you that you have a case...you better run the other way. 

Now, beyond that there are NO laws that says a company can not call you between certain hours.  Why did they call you at that time..who knows.  But one thing I would wonder is even though you are in the EST, what time zone is your account and number in.  As if your number is actually something like a CA or other Western US phone number it was actually only 8:25PM and T-Mobile would have absolutly no idea what time zone your phone is actually in.

Of course the simple answer to this is to contact T-Mobile and request that you be taken off of their list for calls like this.  That is something they are required to do, through the Do Not Call List.  However, even if they violate that there is nothing you can do personally except report them.
