I don't think its right for a returned check that is paid by the bank the second time that it is presented to be charged a 30 dollar fee. I would understand if the bank on't pay it, but if they do why charge the fee. The first time this happened to me it caused 3 more checks to bounce. Wal'Mart never done this until they started using TELECHECK!! Thats just Tennesse's way of taking more money away from people who need it. I'm disgusted by it. If I knew I would win I would sue and own TELECHECK!!!

 While i neither agree or dis agree with either side here. Both parties are in the wrong. The check shouldnt have been bounced in the first place, weather its an accident or not. And walmart/Telecheck shouldnt have tried or pulled anymore money than the face value of the check.  You will find most banks will reverse the 25 dollar fee from telecheck without question because by law they are only allowed to pull the face value of the check no matter what they may state in their fine print clause. The money telecheck is suppose to collect is through notice to collect a debit first, and then give the option to pay by cashiers check or money order and only then are they suppose to proceed with withdrawing funds from your account. And even then they must still have the courts approval. Telecheck does it because they figure most people arent going to argue this fact. Or they figure most people dont or won't know what to do. And sadly their right. They also know by pulling extra funds from your account after they are available causes a vicious cycle,especially to those who dont monitor there checking account closely. It could cause even more checks to bounce causeing more fees that more than likely will go to telecheck which is how they continue to make their money. So to sum it up if you dont want telecheck in your pocket and causing mayhem in your bank account make sure you have money in the account before you write your next check.

I have had three of these fees this month alone from telecheck and if you think that the only time they charge is if your account is overdraft for non sufficient funds you have no idea what you are talking about. When I had the charges levied I had at least ten times the amount for any purchases I made in the account during the month they were levied. Since I just noticed these fees and there is no explaination for them I am contacting my credit union, my lawyer and the attorney general for this state as there was nothing posted saying telecheck was going to charge me for anything and no, I didn't have a bounced check or overdraft or NSF in my account during this month. Stay tuned - I'll get back to this forum and to the person or persons that seem to think they know everthing. I don't normally waste my time typing out stuff like this but some people seem to be working on the side of these companies even when the companies are definately in the wrong and thats something that is just wrong!

Each state allows companies such as Telecheck, Certegy, etc to collect up to a certain amount for a returned check. This is to cover the time and expense of the company to have to put the check through with a customers bank for collection which they shouldn't have to in the first place had you not passed a worthless check.

It is against the law to present a check to a merchant for any type of services or to acquire merchandise and knowing the funds are not immediately available.

You may want to start issuing some good checks in the future if you don't want to run into this type of a problem.

There is no law that says a company or merchant has to accept your checks or accept checks period.

As for filing a law suit against anyone I hope you don't use one of your checks to pay the court filing fees with otherwise you'll have even worse problems. Looser!!!!!!

I just love how some people can totally twist things around to where they think they are the victim. The sad part is I think this person probably really does believe that they were the one victimized. To the OP you want to sue because you wrote a check that was returned by the bank. I have news for you what you did is CHECK FRAUD and instead of trying to put the check through the 2nd time, they could have filed charges against you. Instead of filing a RipOffReport you would be in court in front of a judge answering the charges against you. After you got out of court you would probably be wishing you were only charged the $30. Especially if I read this right and you have a history of bouncing checks. The reason you were charged a fee is because the check was returned, it does not matter if it is later paid. The first time it is returned you were charged the fee. In fact in some states they can charge that fee each and every time they submit it and it was returned. So be thankful that it did clear the second time. If you learn anything from this, that is DO NOT write checks when you don't have the money in the account, or your next report could be coming from the County Jail.

1 you dont write checks for money you don't have to do so is knowingly commiting check fraud. which is illegsl in every state! 2 the check bounced! period ! walmart was charged a fee by their bank for it bouncing even though it was ran a second time a went through. ok so they do not get charged as much but I have and think thier should be no sympathy for someone who writes a bad check! and dont claim it was an accident your probaly one of those who also think a post dated check cant be cashed till the date that is written on it?!?! 3. and again you still wrote a bad check! Lesson : stop writing bad checks ! or writing them thinking the money will be in the bank b4 the check clears your account which is still check fraud

Since telecheck is not owned by walmart. And telecheck is in fact charging you a fee for the check you shouldnt have bounced to begin with. Perhaps you should blame the correct company and leave walmarts name out of it. A lot of businesses use telecheck these days.
