SUMMARY OF ARBITRATOR DECISION

Guillermo J Garza, dba Terramano, Complainant,

v.

Mike Mitchell, Author of Rip-Off Report No. 857590

Complainant, Guillermo j Garza, dba Terramano (Complainant) has challenged the truthfulness of certain statements (each, a Statement) posted by Author Mike Mitchell on the Ripoff Report website at www.ripoffreport.com on March 21, 2012, as Ripoff Report No. 857590 (the Report) Further, Complainant is challenging the status of the Author. The Author contends that the Complainant provided tiles to be installed in a home and that the tiles were of unsatisfactory quality. The Complainant denies the allegations in the Report and further contends that the Author is not former customer but a competitor. Both the Complainant and the Author have agreed to submit the dispute to the Ripoff Report VIP Arbitration.

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant for determination of the truth or falsity of the Statement. The Author has not provided a response to the Complaint.

The Arbitrator was asked to decide whether the preponderance of the evidence submitted establishes that each Statement is true or that it is false. The Arbitrator determined that the statements which have been redacted were false. Therefore, according to the Rules, those statements have been redacted. If the statement identified by the Complainant was determined to be an opinion, no determination was made as to that particular Statement because an opinion cannot be determined to be true nor false.

The Arbitrator was also asked to decide whether the preponderance of the evidence submitted establishes whether the Author is, in fact, a former customer of Complainant. The Complainant denies that the Author is a former customer. The Complainant states that he believes the Author is a competitor, although he does not identify the Author. The Author was given an opportunity to provide evidence to establish the Authors status as a former customer of Complainant but did not do so. Accordingly, the Arbitrator found that the Author is not a former customer of Complainant.

It was probably the worst experience of our new home building. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). The tiles showed up and looked good at first till we unpacked them. First they were not sealed properly and then about half of them had cracks and chips in them. they looked horrible. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). in the end we had to remove the tiles that we layed and go and purchase some more from another vendor of terracotta flooring. this guy never looks you in the eyes when you talk to him. i should have known better. warning to the wise. do not buy from this guy.

guillermo garza is from mexico and only recently moved to san antonio. he could take your money and leave at anytime. be careful. his european tiles are made from cheap saltillo clay per my builder and they were not of european standards. but a very very cheap copy....chip flake and just a maintenance nightmare.
