As owner I am confused by this complaint. The loan for this client closed as scheduled with proper disclosure for the services that we are legally able to provide. I am not sure what this consumer means by "receiving his credit card deposit." The client was credited his upfront deposit at closing as shown on the settlement statement and as we do for all loans. ALL LOANS require a deposit to pay the appraiser on a home loan as appraisers get paid regardless of the outcome of a loan. Lenders are required to pay the appraiser because due to federal regulations consumers are not allowed to pay the appraiser directly. So as a lender we collect the appraisal fees after the application and disclosers are signed.
This client paid the appraisal fee and then was credited the appraisal fee at closing as can be seen on the closing statment. For all loan closings lenders credit any out of pocket fees that are paid in advance. If I am reading this complaint correctly this consumer believes they should be credited for the appraisal as a deduction in costs at closing and also receive cash back for the services rendered by the appraiser which is neither logical or legal. In addition, the loan officer wo is mentioned in this complaint discontinued employment with our company so was unable to respond to the consumer after closing. As no communication was made with management from this consumer this is the first time we heard of this complaint.
Once again, an invalid complaint has been made on this website for a loan that closed properly as disclosed. The client was looking for something that is not in the scope or legal right of a lender. Please take this into consideration as we companies receive these complaints with no proper due process nor recourse, nor any indication that a complaint was filed. We find this to be unjust as consumers all have a resource with their local state regulatory agency or federal agency to file valid complaints. If a client was ripped off then we would be reprimanded. As it stands, out of the 400,000 people that have contacted us for a home loan in the past decade we stand by our record for service and trust. Our name is now tarnished due to this and other invalid complaints with no recourse. This is unjust. Thank you for your understanding.

After advising texaslending.com that I was going to post negative feedback and express my dissatisfaction on this site I received an email in which they explained the reason why I had not received my credit card deposit back. The reason, they explained, is that they had given me credit towards my closing costs. Although this message explained the credit card issue, they failed to clarify the reasons for ignoring all my calls and emails.
