Complaint Review: The Kentwood Company At Cherry Creek - The Kentwood Company Karl Lueders - Denver Colorado

My recent home purchase with representation by the Kentwood Company at Cherry Creek and broker Karl Lueders did not go well at all. I will outline my issues below.

A. Problems with the house not reported by the inspector that Kentwood's broker provided.

-Kitchen, Dining & Entry floors, spacers were left in the grout. Grout is falling out and cracking, tiles are cracking. Floors will have to be completely removed & replaced as result.

-New grout put over old grout in main bath. It is falling out causing leak into basement. Leak is from a bad repair.

-Water damage to subfloor visible from basement.

-Misc other problems. Facing thousands of dollars in repairs

B. Misrepresentation

-At my closing, the Kentwood Cherry Creek broker representing me, Karl Lueders, lied and told the title agency and sellers that I had requested a separate closing. He told me the sellers had arrived early and had already begun so we would be in a different room. This was my first home purchase so I was not aware that closing in separate rooms was not typical. I had no opportunity to communicate directly with seller. Had I been able to speak with the sellers, I would have known that things that were supposed to be fixed, were in fact, not. I would also have known that Karl Lueders was not, as he promised he was, communicating my concerns to the sellers.

-The broker did not act in my best interest as his client but rather acted to facilitate the sale of the house at my expense.

C. Failure to respond

-Managing brokers of the Kentwood Company at Cherry Creek have been notified of the behavior of their broker, and have been made aware of the problems with the house. They requested that I submit written communication and estimates from contractors for repair to the home. I provided all the required information and they have failed to provide any form of substantive response.

-I have repeatedly requested copies of the agreement I signed with the Kentwood Company at Cherry Creek, which the broker should have provided at the time. They took a substantial amount of time to finally get the copies to me after I cc'd the managing partner of the business.

-They respond to any correspondence with variations of 'we're working on it' and have also responded to the Better Business Bureau complaint in the same fashion. They have known about the issue for well over a month and are unable to come up with any sort of substantiative response to the situation. In the mean time we find new issues with the home on a regular basis and have had to shell out a considerable amount of money to fix the problems.

I have begun to file complaints with the Colorado Department of Regulatory Agencies as well as the Denver Board of Realtors. I don't have much hope of any sort of positive outcome with the Denver Board of Realtors because my broker Karl Lueders' managing broker Gretchen Faber is a member of the board as well as NAR director.

We have begun a website to serve as a cautionary tale to all new home buyers and this also chronicles the details of our continually unwinding saga. (((Redacted)))

We began hopeful that Gretchen Faber, the managing broker of The Kentwood Company at Cherry Creek would assist us in the matter but now it appears all she intends to do is stonewall us. If not for the material misrepresentation of their broker Karl Lueders, we would not be in this position.
