I would like to file a complaint against Exceed, I was told by my sister that I would receive $500 dollars check by joining their “5 years homeowner reward program”. I was told that if I agreed to “membership’ with the program I was for 5 years under no obligation to sell my home but if I did decide to sell my home in the next 5 years I would have to use one of their participating realtors.

My sister was told by their representative that all realtors in my area are part of this program My sister emails them my address, phone number and email address to be entered to this program. I have never received any sort of written contract to read or any sort of contractual agreement, also never got any correspondence to be told that I had a matter of days to be able to cancel this "called agreement". I have no record of receiving any further communication until 07-11-15, I got a letter from Exceed with an enclosed check for $100.00 dollars, I did cash the $100 and still was not aware of the stipulations of membership to Exceed.

My sister came to me on May 24-2017 mentioning what it was happening to her, she told me that these people EXCEED said that they sent her 3rd. check on 05-24-2017 which was false. She started to make an online search for this program. We found out that they do not have the best reviews, they have thousands of complaints even recently by that year 2017. In 6/7/2017, I contacted Thomas Brown at Exceed LLC by telephone. I expressed that I wanted to terminate my membership with Exceed.

It was the time that I was told that I could not terminated my membership because I had “signed” a contract that stated that if I terminated the agreement it would have to pay a penalty of 1.2 % of my home value if I sold my property. I was shocked and told him that I had no knowledge of ever signing any sort of contract, later followed up with an email that enclosed a contract that I had never seen and stipulations that I was never told about with my initials at the bottom but no signature. I believe that the Exceed Homeowner program is very deceptive in their advertising and trying to get you to agree to be a membership and does not provide full disclosure about the stipulations of the agreement to membership into their program.

I also wish to return the $100 dollars of the first only payment received from them. I would be happy to refund this (1) payment made in order to resolve this matter. I have made an attempt to bring this issue directly to Exceed through BBB in CT., Ms. Martinez from BBB at CT sent me a letter saying that this people did not want to cancel it because of the reasons I am giving in here and they said that is all a false statement but they did cancel to my sister after she returned their $200.00 that she got from them. After all this, I have tried to several attempts to cancel it on their online platform but not success, I have not heard anything back from them anymore. To conclude, I wish to terminate my membership with the Exceed as soon as possible.
