We were called by this company in April of 2007. For $199.00 they would list our timeshare-if after 9 months, and no sale, they would continue to sell at no additional costs, and they would re-imburse the $199.00. A man by the name of Bill Ellis, told us if sold, they would take a 4% commission. On August

17,2007, Ellis called back and told us he had great news. They had a buyer willing to pay $23,500 for our timeshare. The buyer was not willing to pay the closing costs however, and that we had to pay the $600.00 upfront. The closing would take place in 45 to 60 days.

At the end of Oct, I called Ellis again to find out what the hold-up was, as we had heard nothing. I left a message through a secretary. I received a return call from a person by the name of Bob Downey, that apologized up and down, and told us that no one should have promised 60 days, as they couldn't close until 90 days. I told him that was not the deal. He became obnoxious and told me not to call him until the 90 days was up. If I hadn't received the papers in 2 weeks, to call him, until then, he didn't want to be called again.

We waited the 2 weeks, and again called. This was on Monday, Dec. 3rd.2007. He told me again to call him back if papers weren't to us by Fri. Dec 7. Called on Dec. 7th, he was not available. Called repeatedly all the following week. Finally talked to him personally on Dec. 13. He told me he had good news and bad news. The company that had promised to purchase the timeshare had backed out--but he had it resold, and to call him in 2 weeks.

At this point, I already knew that this was a scam. I had called the Better Business Bureau in Nevada at 702-320-4500 to inquire. They informed me that this company had formerly done business under a different name, with the owner identified as Bill Armstrong. I found this ironic, as the person that initially called us was Bill Ellis. We were no longer able to talk to him, and were now dealing with this Bob Downey.

At this point I advised Downey that I suspected this was a scam, and told him what the Better Business Bureau had told me. Again-he became beligerant and yelled at me over , and hung up, since then we have not been able to contact them. Their voice mail at their supplied number is full. I have e-mailed them, demanding a 48-hour reimbursement to our CC---but nothing. I have faxed them. Again Nothing. These people are ruthless liars.

I told them the reason we were selling was because of a granchild born 16 weeks prematurely, and the hospital bill would be over one million dollars. I begged Bill Ellis not to rip me off-and he made all kinds of promises. I researched this company, and couldn't find anything negative under their name...If only I had known about Bill armstrong and Bob Downey.. Can anyone help?

I have submitted a Ripoff Report about Timeshare Solutions but so far I don't think you can see it (See the report from Madison, WI). I have the same story with both Fairfield Resales and Timeshare Solutions. Paid them $550 through my Visa card and then they disappeared. I contacted the card company and contested the bill. I doesn't matter how long it's been, call, contest the charge, get your money back!! This is a double bonus, no only will they credit the money back to your card but they will then immediately charge the local bank that was dumb enough to give these guys access to the Visa system. The bank isn't going to do a lot against these guys for 1 $550 charge but multiply that by 20+ people all getting their money back and see what the local bank does to shut these people down.

Here is a copy of a rebuttal I put on a complaint similar to yours. Call the authorities immediately........ I will attempt to give you some helpful advise, I am not an attorney or make any warranties or representations on the advise I give you as follows: On the contract, I would seek independent legal advise immediately, ask your attorney about negligence and negligent misrepresentation, fraudulent misrepresentation, breach of contract, and void contract (due to fraud). Get all your pieces of paperwork together, anything you got, receipts, faxes, letters, anything. Even if you can't afford and attorney, many of them can do a consultation with you for free or for a small fee. Ask them how much to send a demand letter off or at least give you an outline of what your potential damages are here and what your case is. You really need some good independent legal advise and sounds like you may have a good case. Keep notes of everything, send letters to the company and I would also submit a complaint to the FTC and the Attorney General in your state and the state the company is from. See if PayPal can still refund your charges, call them, never hurts. See if credit cards can be charged back. Tell your credit card company not to let them charge your account anymore. Also sounds you are dealing with a criminal act of fraud (that went across state lines), call your local police and the FBI Immediately. NOW! The FBI does have a whole fraud investigations unit. CALL THEM ASAP! Send them copies of your paperwork. Sounds like you paid a lot of money for nothing!!
