EDitors NOTE: The report below was found to be false. They never responded to our email to assist them. Rip-off Report contacted the Broward County Building Department and found that Tom Smith Development has no open issues and all Certificates of Occupancy have been issued. The charges made here were completely false. The reports posted were all posted by the same person using different email addresses .. but they were all posted from the same IP address.. !! Rip-off Report does not condone this kind of behavior. Rip-off Report has confirmed, Tom Smith Development, Inc. is a Verified safe business.. With the many thousands of jobs preformed each year by Tom Smith Development, Inc , All Year Electric Inc., All Year Cooling And Heating, Rip-off Report staff fails to find any other complaints filed anywhere about them. Only those filed by the same person. After all, they have been listed on Rip-off Report at the very top of most search engines. Case: Tom Smith Properties illegal contracting and falsifying documents

On 28 March 2005 Richard C. Epperly and Ricardo Estrada entered into a contract to build a home from Tomas Smith also known as Thomas A Smith of Tom Smith Development web site www.tomsmithdevelopment.com. At the time we believed he was a contractor with a legal company with all the licensing required and conducting as required by law. Washing Park Properties, LLC, owned the land Mr. Smith is the managing member of this company. Mr. Douglas Fleishman a licensed real-estate agent applied for the building permit on 2 Jun 2005. He signed the Disclosure Statement 489.103 (7) affirming he was the owner however he was not and the house was under contract to be built and sold. This property was illegally built and poorly done not in a tradesman like manner. The house was full of defects to include the fact they had forgotten to insulate the roof at all. My contract states I will get R-11 insulation or better he installed R-4.1 instead (see contract page 8). I kept calling to remedy the problems as the contract provided 30 days to repair defects etc. His office would answer All Year Heating and Cooling. This is when I realized Tom Smith was in fact an A/C contractor and not a building contractor. I then sent a letter to Mr. Jack Fisher in code enforcement that then called Mr. Smith to solution the problems. Mr. Smith came to the house and promised me he would make all the repairs. He never sent a contractor only himself. I was greeted by subcontractors a tile man, a kitchen fabricator, a plumber, electricians, a designer, a handy man all of who informed me that they worked for Tom Smith directly. I knew then he was acting as a contractor. He had an additional twenty four thousand dollar increase from the contract price due to hurricanes Katrina and Rita we settled on twelve thousand. How can he have this increase when he is the contractor and saving an additional 25 to 40 percent of the construction cost by building it him self. This is a clear case of price gouging. He also attempted to charge me for a tree that was removed from the property and code enforcement found out about it. I refused and later asked about this charge at the code enforcement building however they had no record of it.

I had another contract to purchase a second home at 1109 NW 1st Ave, Fort Lauderdale, Fl 33304. He had recommended that I check the property during construction to avoid the same mistakes, which he had made the first time. I had begun to investigate this property only to find Mr. Smith at the job site meeting with inspectors and trades, he was running the job. He was the contractor on the project. I listened while he spoke to the plumber after I told him the tub in my unit was damaged; he had called it in to the plumber himself. Upon further inspection I saw many mistakes, R-4.1 instead of R-11 as on the contract. The roof had hundreds of spots where someone had stepped in expanding form and walked all over it. Two rooms had the floor convex almost an inch higher in the center. The list went on and on. After knowing that he was not a contractor I refused to close and demanded my deposit be refunded. I know for a fact that Mr. Smith has contracted these homes himself and has used a contractor to pull his permits and make the shell he does the rest.

My name is Joe, and my wife and me bought a home from Tom Smith Development back in 2007.  I couldnt believe this web page when I read it.  Im not the type of person that would even write to a web page like this, but my wife was searching for something on Google yesterday and found this and mentioned all this over dinner last night and I thought I should say something.

We cant tell you how happy we are with our house we bought from Tom Smith Development.  Everything he prommised was done right.  We love the place.  There was a few items like a closet door that didnt close right, but he fixed it right away.  The general contractor was very helpful and at Tom's okay even did some stuff he didnt have too.  That was real nice.  Even my neighbor who bought a house from him didnt believe me when I told him about this site.

Last winter we had a electric generator installed by him too, and it went real smooth. The guys from one of his other companies All Year Electric did a fine job.  The inspections and all that went real good.  God willing we wont need it, but I know its ready because it turns on every week and does a test.  I also got them to put some extra outlets in the garage.  They did great and the price was real good.

I dont know where this fella came up with all this, but my wife and me think that this is all baloney.  Tom Smith Development built us a fine house, and my neighbor is real happy too.

Nice rebuttal Mr. Tom Smith I have noticed this is becoming a volley of rebuttals so I decided to build my own web site so I may post important evidence in a larger arena. Just add sucks to Mr. Smiths web site on your direct web browser not on google yet but soon for your holiday reading. It will be important to note that what I am posting is official government records complete with signatures, dates etc. unfortunately the web building process is slow due to official approval by higher ups. I will do my best to have a complete history for global exposure by Xmas. I must now address the issues at hand so here we go. Mr. Smith did not have everything repaired as per our agreement when he came to my house and I gave him the tour and list of defects, Mr. Smith shook my had and looked me in the eye and said "you have this coming some times you just have to take a loss on one". I really bought into that and got that good feeling one gets. It was not long before I new I had been snowed. Yes I greed to pay the 12K increase, at the time I was in Colorado and I was assured the house was outstanding. I was naive and believed that I was to close on one very nice project. Yes I am an investor and it follows that one becomes greedy and looses sight of reality. Yes I sold the unit for 30K more than the purchase price I will go into great detail on how that money was spent on the home for resale check web next week. Yes the house passed all inspections. Yes my wife was the agent who arranged the purchase and sale. Yes the insulation meets minimum requirements by Broward County Code. Mr. Smith possibly could be correct that my statement of 50% additional energy cost may not be precise. I tried to find your Electrical license you claim is # 94 CME 1506X in Myflorida.com to no avail. Please feel free to email me the link so I may post it on my web site and remove the statement but until now I show you as Qualified by Mr. Randy E. Miller License # ER0012903. He also Qualifies South Palm Electric. It would be interesting to see what would happen if someone had a claim against your company, who would pay Mr. Smith or Mr. Miller or would the attorneys ensure no claim could be possible and who would pay the attorneys fees. I guess the OJ case sets the stage for that answer. The way I understand it a Qualifier does not need to even know what you are doing forget supervising, he could live in France for what anyone cares. I am beginning to understand why you can operate the way you do because no one is regulating this. The same way no one is regulating Mr. Smith. My statement does not question the legal status however the competency of his workers. They came to my house to argue with me as if I dont know how to read plans. There were to circuits missing in both bedrooms there was supposed to be switches to turn on lights from outlets on the far walls. In their place were dummy plates and I was told that is the way it was. Wrong, I checked the plans and again had to due the contractors job as many times before. After arguing with two young guys who did not know half of what they were doing it took them days to finish what should have taken hours. Then days later the same circuit failed because the single gang box was so stuffed with wires the connections came loose. At one point the handy man Louie ask me to help him fix it because the guys were to busy. The A/C issue is another of Mr. Tom Smiths testaments to Mickey Mouse construction, having a perfectly shaped slot for a nice cardboard filter that one would simply slide into place and easily replaceable no Tom Smiths expert A/C installers put the drain pipe and or wall directly in the path of the filter slot Good Job Tom! I think the A/C guys are probably as well supervised as the electricians are, from France. Mr. Smith what is this bull about the windows being ordered I was informed by your alcoholic handy man in between beer breaks out of his trunk that you were not going to replace all the windows that were scratched, that I needed to pick the three worst ones and live with the rest. Of course the fact that the windows were bought in Home Depot off the shelf has nothing to do with it. Let me guess they were out and you had to have someone at HD hold some for you NICE ONE. As for the false permits, which I will post on my web site, you somehow had people not on the deed, not owners, not part of the contract request for Owner/Builder Permit, which allows the owner of a property to build their own home. Fl. Statue 489.103(7). Disclosure statement states the owner must live and not rent for one year after completion or the state considers the home for sale or lease and in violation of this exemption. Did Olga Walker actually sign one of those or does she know about it at all, as with Eddie Garcia and the fence permit someone signed for him that he has no idea about. This issue should not be a problem Olga being a real-estate agent I am sure she agreed. Mr. Douglas Fleishman who has a criminal history signed for my home, see affidavit posted on my web please. Mr. Tom Smith knows that the department of code is overwhelmed and simply does not check ownership so on goes the creative permitting. The final inspection I question. How is it possible to have a final inspection with no insulation at all in the attic and five circuits that did not work? Did I remember to inform everybody this was the second home found with no attic insulation? Did I forget to mention this is the second house that was supposed to have R-11 insulation in the walls and did not? I must say Mr. Tom Smith is consistent, as the paper trail will show. I found a letter/note from Toms so-called qualified electricians stating the problems in the house with the electrical. This was a problem prior to the C/O and no one cared to correct it. According to Mr. Smith if it gets past code then it must be ok. So it is ok to give someone the wrong insulation as per the contract because code has a minimum that has been met. Mr. Smith states that there is R-11 installed in all exterior stud walls, there are no exterior stud walls to my knowledge and I have a set of plans to prove it they will be posted on my web site. Mr. Smith apparently feels that he can state anything he likes on his contract and it will not matter because he can simply follow typical building practices to the minimum of the Broward code and we should just accept that. I guess Mr. Smith does not know about other insulation choices, or maybe he does not care to. There is a large movement towards energy efficient homes I really thought Mr. Smith was a part of that and I liked the fact I would be reselling a green home. Little did I know Mr. Smiths idea of a green home was to take the green home himself to spend it later and not on my house. Investor or not I have the right to what is in the contract, R-11 or better. News flash R-11 insulation can be sprayed on with a thickness of about 2 maybe less depending on the product, I will post the government web stats and product info on my web for Mr. Smith. You see Mr. Smith this will be just one big expensive education for the both of us and I love to learn. I guess its ok to ignore my problems and calls because I am an investor that is discrimination and I resent the fact that he uses that word as if I were less of a customer than anyone else. As for the false permits, which I will post on my web site, you somehow had people not on the deed, not owners, not part of the contract request for Owner/Builder Permit, which allows the owner of a property to build their own home. Fl. Statue 489.103(7). Disclosure statement states the owner must live and not rent for one year after completion or the state considers the home for sale or lease and in violation of this exemption. Did Olga Walker actually sign one of those or does she know about it at all, as with Eddie Garcia and the fence permit someone signed for him that he has no idea about. This issue should not be a problem Olga being a real-estate agent I am sure she agreed. Mr. Douglas Fleishman who has a criminal history signed for my home, see affidavit posted on my web please. Mr. Tom Smith knows that the department of code is overwhelmed and simply does not check ownership so on goes the creative permitting. The final inspection I question. How is it possible to have a final inspection with no insulation at all in the attic and five circuits that did not work? Did I remember to inform everybody this was the second home found with no attic insulation? Did I forget to mention this is the second house that was supposed to have R-11 insulation in the walls and did not? I must say Mr. Tom Smith is consistent, as the paper trail will show. I found a letter/note from Toms so-called qualified electricians stating the problems in the house with the electrical. This was a problem prior to the C/O and no one cared to correct it. According to Mr. Smith if it gets past code then it must be ok. So it is ok to give someone the wrong insulation as per the contract because code has a minimum that has been met. Mr. Smith states that there is R-11 installed in all exterior stud walls, there are no exterior stud walls to my knowledge and I have a set of plans to prove it they will be posted on my web site. Mr. Smith apparently feels that he can state anything he likes on his contract and it will not matter because he can simply follow typical building practices to the minimum of the Broward code and we should just accept that. I guess Mr. Smith does not know about other insulation choices, or maybe he does not care to. There is a large movement towards energy efficient homes I really thought Mr. Smith was a part of that and I liked the fact I would be reselling a green home. Little did I know Mr. Smiths idea of a green home was to take the green home himself to spend it later and not on my house. Investor or not I have the right to what is in the contract, R-11 or better. News flash R-11 insulation can be sprayed on with a thickness of about 2 maybe less depending on the product, I will post the government web stats and product info on my web for Mr. Smith. You see Mr. Smith this will be just one big expensive education for the both of us and I love to learn. I guess its ok to ignore my problems and calls because I am an investor that is discrimination and I resent the fact that he uses that word as if I were less of a customer than anyone else. I will have Mr. Smith know I have rights like any other and please check my web site, as I will be going into great detail of the entire event and every one of Mr. Smiths homes will be posted systematically complete with all permits, time lines, and false documents. I will show everyone how he changes the ownership to suit his needs. I will show how he manipulates the banking institutions, the code enforcement department, etc. Mr. Smith has employed some contractors and trades and has learned how the system works and Mr. Smith is working it well. Had I known what suffering I was in for I would have never have done business with Mr. Smith. My plan is to warn as many people as possible and to assist the rest in getting satisfaction. I realize that with Mr. Smiths millions of dollars I may be squashed but before I go I will ensure Mr. Smith is famous, a global household name. If I do wrong I will do my best to correct my error and I will concede. Mr. Smith knows no humility and cannot comprehend his actions he is truly a legend in his own mind. You once told me Mr. Smith nothing personal just business.
