Well, I did what I said I would do and I traded my truck in, although I really didn't want to. My husband loved the truck, and we used it for so many things, not sure how we're gonna make Home Depot trips now. We got a brand new 2006 Saturn Ion 2 and the interest rate is alot lower. I'm finally rid of United Auto Credit. Well the finance manager there, Bill; called United Auto Credit for the payoff amount. They paid off my loan to them and gave me $5000 trade for the Ranger plus the rebates. Bill had the pleasure of speaking with Mr. Dave (the jerk). Bill explained that we were trading the vehicle in, for a brand new one, and he needed the payoff info. Dave gave it to him, and added in for good measure (AGAIN AN ILLEGAL ACT) "You know they still owe me for this month!" Unfriggin Believable! How dare he! He had no business telling him anything, although I told Bill why I wanted to be rid of this company, and he found out first hand. After Bill told Dave that we wouldn't owe them anything cause he's paying off the loan, Dave told him "I'll still come after the vehicle!" Bill said he was absolutely flabergasted! He told Dave, "How can you come after a vehicle that I pay for, and retain ownership of? You can't. You can come down here and try but you won't get very far!" At that point, Bill told me he was outraged with Dave's behavior, and although the dealership has a relationship with United Auto Credit, he said he's never dealt with Dave before. I told Bill when we first starting putting this together that Dave was the biggest jerk on the face of the earth, and he told me that he wholeheartedly agreed as we were signing the paperwork last night for my new car. I was approved thru the Saturn Program this time, yippie! I emailed my attorney all the items I could find on United Auto Credit on the internet, and now that I am rid of them, I fully intend to sue them on an individual level for harassment, violation of my privacy, violation of Federal and Massachusett State Laws, and emotional distress (I haven't been able to sleep due to their continued harassment, and worrying about someone showing up at my home when I'm home with my little guy by myself). My husband and I gave up a great vehicle (but realized due to gas prices, the truck wasn't economical and the Ion is - 24 mpg city and 32 mpg highway - way better than the truck) just to get rid of these jerks! I'll continue to update my report to let everyone know about the lawsuit progression. Don't be afraid to take these jerks to court for them violating your rights! Stand up for yourselves like I have and fight back. Specialty lender or not, they have no right to bully, harass, threaten and belittle you or anyone else. They lie to get the info from your loved ones on you, and god knows what else. THIS IS ALL ILLEGAL! Thanks for listening, and I'll update soon! Kathie Baldwinville, Massachusetts

By the information you provided they are violating collection laws. As for a class action suit, the only one who will really benefit from that is your attorney - instead you should have him file a suit for you personally for these violations. I admit I smiled when I saw your "Mafia style collection" in the title - I pictured the guys from the Sopranos showing up at your door. One comment, your payment due date is the date they should receive the payment by, not the date of mailing. Be careful because legally the auto is theirs until you have a clear title and it can be repossessed from your property (in most cases you give them explicit permission to enter your property to repossess if you are in default). They are more likely to take it from your workplace if they can find it. Trading it in may be the best option, but if they have reported lates on your credit file you will likely end up with another subprime loan. Get the payments up to date, keep them their but don't let them off the hook for the collection violations.
