We are alleging that US Merchant Systems is in breach of contract with respect to their cancellation/termination policies.
We signed up for credit card processing in 2008. Our original signed agreement states that we agreed to an early termination fee of $250 for a period of three years. We cancelled service in May 2013, five years of loyal service later, and were assessed a $350 termination fee.
Upon contacting customer service we are informed that our contract automatically renews for a period of one year and that we had a 90 day window to cancel via written notification. Further discussion led to the (supposed) refund of $100 as our original contract only stipulated a $250 fee. This admission and reduction alone indicates tha they know about our original and agreed upon contract.
I perused our original signed contract and there is absolutely no mention of an auto-renew feature and a continuation of our early termination clause. Adding extensions of termination agreements into subsequent years of service is completely out of line and a breach of our original contract, deceptive and I feel fraudulent under California auto-renwe contract laws.
Several calls to customer service have produced nothing close to customer service so I have been left with no choice but to file with the FTC, the Attorney General's Office, the BBB and their Aqcuiring bank. A sad way to treat a loyal customer of 5 years.
