First off all let me say I am not just mad at company for wrong doings to me that is NOT why I am writing this report. I am writing this is hopes of preventing other people from going thru the same problems and headaches so many of us have been thru.



Where to start..... hmmmm oh yeah I remeber now how could I ever forget right?????



Called US Xpress went to orientation 3 days of normal b s Physical,drug test,backround investigations and so on...



Lets start with that orientation:



1st of all I called company they tell me that they are not hiring anymore company drivers in my area ( which later I found out in allmost any area) and they explain to me I can either team ( which I didn't want to) or I could lease a truck. After thinking it over I called back and decided I would lease a truck. Went to orientation the whole time for the three days of orientation they kept putting our names up on a board with paper and they tell us if our name is on board then during our 15 minute breaks we had to go into an office down the hall from the orientation room and straighten out a problem with the staff there so we could continue to be considered for being hired.



Now 1st off we all thought we had a job when they sent us into orientation in the first place we didnt know that they really dont tell you if you are hired or not till after orientation is complete.



Now lets recap your not hired yet and they keep calling you into this little crammed office for questions regarding past accidents,employment and so on so the whole time you are going thru orientation your nervous you will even get a job let alone a lease truck to drive. So thats number 1.



2.They make you drive a rental truck for the first month or so usually a volvo then they have you pickup your official truck. They offered me a Peterbilt 2009 or a 2007 Freightliner. Now I was making good money at the time and had the mind frame of well Im making good right now so I can afford a Peterbilt even though  it is more expensive then the freightliner. Little did I know they were setting me up for a hunk of junk.....



They offered 2 trucks to me both 2009 Peterbilt's 387 model's.



1 smelled so bad and had so many problems that I declined it . The other had probs too but I wasnt worried because they assured me that any repairs that need to be made will be covered under a 30 day full bumper to bumper warranty then anything else would be covered under a 5 year 550,000 mile warranty their after and a 750,000 mile warranty on transmission also.



So I accepted little did I know what I was in for.



List of problems with the truck I accepted:



Exhaust stack leaking exhaust fumes into cab>>> Bad shocks>>> Oil leak>>>bad tires>>> bad alignment>>>>Speed not correct>>>> Clogged DPS Filter......



Now I know what you are saying how does it have so many probs being so newe. Well truck was driven by a team b4 I got into it and it had 185,000 miles on it when I got it!!!! The team who drove it never fixed anything on it and let it rag out lucky me right!!!!!!!!!!



Well I had those things fixed  slowly yet surely but then broke down in Charleston, Wv the DPS filter got clogged was there for 6 days waiting for truck to be fixed. Well was allready broke from having no miles due to being repaired at other shops for a week on the other problems I listed so then in starts the whole I started to digg from taking emergency advances for paying for motel/food expenses etc etc... all because they gave me a problematic truck and would not let me change trucks either.



So I was broke for like 2 months paying back trk payments/ insurance payments advances and so on. They gave me a trk payment crdt and a half but no creidt on insurance or motel expenses... does that sound fair to you???



Well then I was stuck at a consignee for 1 day because they lost the key to their warehouse. I know it sounds stupid but thats what actually happened. It was a Walmart offsite facility in Idaho Falls Idaho I picked up load ontime and delivered it ontime but had to wait over 15 hrs because company did not call for a locksmith till next day to save on emergency locksmith fee's ha ha another lucky me right???!@!



Well I was thinking well I am getting paid dentention pay lkike $50 an hour so I didnt care.....    WRONGGGGGGG......... what was I thinking right...



Never got paid dentention pay nothing called payroll so much they asked me to stop calling. I freaked out on them !!!!



Then I started noticing that money was being held from me on my settlements.



Remeber the 30 day bmpr to bmpr warranty I told you about ealrier well they lied they took all repair charges out of my maintinence account when that money ran out they started taking it out of my settlements directly. Which left me with no money and started taking out 100% of money earned and sending it to my back child support which I dont mind but I have to eat too ya know. By law they can only take out 50% max to catch me up on back child support but I think they were doing it on purpose so that they can make me suffer from calling them and arguing so much with them.



But do you blame me with all that is said and done to me so far right?????



Well I made up my mind to turn truck into them they gave me credit for most of the repair money but never credited my maint. acct. though nor over payment on child support. Well I got a load to atlanta,ga then drove home emptied my trk out then turned it into Tunnel Hill,Ga. When I got their they would not check truck in saying it wasnt damaged and that I had actually returned it I had to call the police to come out and take a detailed inspection and write in for a report to get proof when I turned it into them that I did so with no damage and I actually turned it into them.This way they cant ruin my dac by saying I abandoned truck or it was damaged when I turned it into them.



When I was home before I truned truck into company I consulted a lawyer and he told me I could get out of lease contract because they didnt pay me on the dentention pay and I had proof they didnt by having all of my settlements. So I did the correct paperwork and mailed it into the corporate office certified mail like I was supposed to so they cant say I broke the lease it proves they broke the lease not me. Well then I turned truck in.



Still they send me statements to my email saying I owe them lease payments even though they have the lease broken paperwork and their truck back. They are letting it stack up on me and I know they are planning to put it on my credit report as to ruin me... what the heck these people are crazy man.....



Well I am looking for others to contact or to contact me  to start a class action lawsuit for my pain and suffering and for the money they owe me!

 Well your case is common amongst companies that lease Trucks...But how about the latest trick that USX is pulling!!!

   All of contractors and lease operators have been told that as of 4/29/11 our percentage pay contract is not good and is being terminated by USX and if we don't come in to sign a milage pay contract by 5/11/11 that we will not be dispatched till its done...I asked how can they break this contract,,,,I was told becuase the contract was not approved by "upper Management",,,I said

rrrrrriiiiigggghhhhtttt,,,,,supposedly they are saying that upper management had no clue that

we all went to this percentage contract....I will say this,,I was making 3 times more money on percentage and taking more loads to places I would not normally go,,and driving less miles to get the better pay too....They tried to convice me that milage drivers were making more money,,I said Bull,,,but who knows maybe I am a better and more reliable worker than other contractors so I may have been getting offered better loads,,,but no mater what,,this is one example of how USX does very bad buisness and runs it in a very shady manner!!!! I have been with the company for over 10 years now and every year it seems to get worse and worse,,very Sad...

But all good things must come to an end soooo,,this good contractor must move on to bigger and better things.....Knowing that back in the 80's Max Fuller had his own father led off the property in handcuffs for no reason,,,I should have stayed away or left sooner...I pray for Max every day and I pray for all of the good people working for Usx and earning such small wages as company drivers and also not getting payed for every mile they turn...Hopefully the upper managment wakes up soon...

Ok, let me start by saying I am a lease operator with U. S. Xpress.  I've been in the program for over a year as well as being a company driver for over 3yrs prior.


If you've been in trucking for any amount of time you should've known that 99% of all trucking companies do not consider you to be employed until you're seated in a truck. Simple common sense tells you that no company in their right mind is going to offer employment until you have shown through your physical, drug screen and employment verification that you meet their hiring standards as well as the standards put forth by FMCSA regulations.

As far as the truck you leased.  Well, you never should have accepted it and signed the lease contract in such a condition.  You made the decision to sign on the line. Nobody put a gun to your head and forced you to sign.

The company does have the right, under the terms of the lease, to come after you for any and all payments owed to them for the term of the lease as a result of you terminating the lease without 30 days written notice.

It's called personal responsibility. Something that seems to be a thing of the past in our country.  Someone else is always to blame!
