I have a mortgage on a mobile home set up in a park. I got it for my sister to live in as long as she would make payments and take care of everything. She recently made me evict her after she failed to pay the mortgage payments.

I've been paying the mortage but do not live in it. I really can't rent it because the park charges to much for lot rent and it's a really bad park, so no one would want to pay enough rent to pay the mortgage payment.

The mobile home park has refused to work with me to allow me to sell the trailer. They took my sister and her husband to court for a Writ of Possession even though they do not legally own the trailer. The have the Writ and are threatening to move it to hold it for payment of back space rent. Let me emphasize, the trailer is NOT in their name but the judgement IS.

Most recently, VMF has gotten involved and says that I have to pay my sisters back rent in so that the park will not move the trailer. They have offered to give me a loan to help pay it, but I refuse to pay something I DO NOT owe. I have no judgements against me, no summons, no legal documents of any sort. In fact, everything about this has been oral to this point.

Now, "Christy" at VMF says they are going to foreclose even though I haven't defaulted on my mortgage. She says they want to move the trailer before the park does and that they can legally foreclose in the best interest of the company even though I am current.

I don't understand why VMF has teamed up with the park and they're both trying to get me to pay something I don't owe and frankly CANNOT afford. I am considering bankruptcy.

By the way, to individual who posted about the threats of garnishing wages, unless things have changed, I believe that NC is a non-garnishment state meaning that one may only have his/her wages garnished for tax debts and child support payments.
