You may have waived your right to sue by opening and using the account. There should be a section in there explaining what the bank will be responsible for (which is basically, nothing) and what rights you have waived. There should also be a section in there detailing the banks funds availablity policies. If any of the deposits that were made were not made available per their policy and you were not told of any additional holds when the deposit was made, then collect all your receipts and sit with a bank branch manager to get your fees refunded. Also, never, never, never rely on the banks online or ATM balance information for anything. Use the online account information to see what transaction have posted and for bill pay. The balance information is useless and misleading. Maintain your own account register and it will not matter what order the bank processes transactions in. You will know exactly what is available to draw on. And you will never pay another NSF again guaranteed. Good luck.
