I BROUGHT MY TRUCK IN TO GET AN OIL CHANGE, 30 MINUTES LATER I GET A CALL TO COME BACK TO THE STORE. THATS WHEN THEY TOLD ME THEY HAD AN ACCIDENT WITH MY CAR. ONE OF THEIR TECHS DROVE MY TRUCK INTO THE SERVICE BAY AND GOT OUT AND LEFT MY TRUCK IN REVERSE IN WHICH MADE MY TRUCK 50 YARDS BACK AND HIT A CONCRETE POST. MY WHOLE DRIVER SIDE BACK END IS SMASHED. I CALLED THEIR INSURANCE COMPANY AND THEY TOLD ME TO GET 2 ESTIMATES IN WHICH THEY WILL SEND ME A CHECK FOR THE LOWER OF THE 2 ESTIMATES. ONE OF THE AUTOBODY SHOPS TOLD ME IF THAT'S THE CASE THEY WON'T DO THE WORK BECAUSE THEIR MIGHT BE HIDDEN DAMAGES TO THE FRAME. SO, IN A NUTSHELL I AM GETTING RIPPED OFF.

It's not in New York. So why do bother to tell what the law is in New York? If you need to comment, look it up in NV and then comment. Otherwise you're nothing but an interloper.

Take it to a differant shop to get quote and get it over with. If you need two estimates get them.

I don't believe that Wal Mart or it's insurance company can dictate ANYTHING at this point. I would consult with either your own insurnace or an attorney.

I have an F-150 and idling in forward ion flat and level ground it might get up to 6 or 7 mph. In reverse it would be less than that because of the different gear ratio for reverse. If you truck is that badly damaged, I don't think it became that way because some employee left it in reverse when he/she got out - unless they want to claim the throttle cable was stuck as well as it being left in reverse when he/she got out of it. Seems to me that someone backed it into the pole and is now fibbing about it. In NY the courts require you to be made whole and the insurance company cannot dictate where to get the vehicle fixed. Further, if the insurance company doesn't want to pay, you see the person (or business) that caused the damage. If the insurance company won't pay to have the truck fully repaired (the alignment of the frame can be checked) I think you should sue them. Good luck.
