Your report said you were there shopping with your husband. Where was he when all this went down? You made it seem like you could not comfort your son because you were unable to pick him up. Where was hubby? Also, you never said anything about what you were asking from them. Do you have medical bills that exceed the $200 amount they offered? Are you expecting some outrageous amount for "pain and suffering"? Your report is seriously lacking in details. Oh, and I used to shop at this location on a weekly basis (and still do occasionally when I go to Texas Roadhouse to eat), and I have never seen any shopping carts that were rusted as you described. In the future, check out the condition of your cart before using it. If it seems in disrepair, get another. I think they totally replace all their carts every couple of years.

Hoping that you'll accept their $200. If they're offering up $200, it means that they know you have a potential suit on your hands. Quite often if you call them back and counter offer, they'll accept it so that they don't end up in court. I for one don't feel that $200 is just compensation for that type of injury, but don't get outrageous either. Try the $750-$1000 range, as that seems reasonable for both the medical, follow ups, and pain and suffering. Happy Holidays to you and your family, and please keep us updated! Good Luck!

I hope you saved that message on your answering machine! Since they admitted guilt, and you have it saved, your attorney can have a hayday in court with them!! How is your son doing now? You didn't mention if you took him to a doctor or not. No child should have to go through that kind of trauma. Good luck and Merry Christmas!!!

It's nice that your husband wants his pregnant wife to do everything. Sounds like a healthy family you have there. As far as the settlement goes, how is Walmart supposed to know how much the medical bills were? Seriously? Did your son require stitches? Did you even take him to the hospital? Did you have to take time off work? (I'm assuming no, since you seem too busy getting knocked up every 9 months) Or did you just go straight home? If you did go to the hospital, get the bill, send it to Walmart and go from there. Or else name a price that will satisfy your anger toward what happened. Walmart is settling because they realize the negligence on there part from not identifying the bad cart earlier. Maybe in part of your settlement deal, you can force Walmart to hire "cart inspectors" who look at every cart that comes in from the lot for defects. And, I guarantee you won't stop shopping at Walmart, you rednecks never do.

You didn't take your child to a doctor so your medical expenses are what, a 50 cent bandage? If he was that bloodied a ambulance should have been called. Why didn't your husband carry your child? Now don't take this as saying it is all your fault, but as a parent you bear some responsibiility. If a two and three year old are too much to handle, either leave both or one at home with your husband. Or watch one while your husband watches the other. Your husband didn't seem to be doing much to help while all this was going on. There are hazards everywhere. It's up to the parent to be paying attention to what they are subjecting their children to. That's part of being a responsible parent. If the carriage was that damaged, you should have noticed it and gotten another. 200 dollars seems pretty generous of Walmart for what you put your child through. I hope that your children have recovered and are doing well.
