Hi, my names David and I have been an OTR driver for the last 7.5 years. I have a stay at home house wife and 4 small children! I work very hard to make a living and feed my family and I know theres alot of drivers out there. Thats why I'm taking the time to post this.

Well, this all happened about 3 years ago. I took a driving position with "Waller Truck Co Inc", out of Excelsior Springs MO.

I gave them 2 years of my time and really bearly made ends meet but couldnt afford to quit! I'd drive 3000 + miles a week for no more then $300.00 a week and thats not much after all my trucking expences. During that time, my dispatcher would be just as hatefull as could be and me, being the christian man I am, would just take it, along with the thought of losing my job and having my 4 babies go hungry while I search for another! I tried to report it to " Tim Crowley", he was the main supervisor, but he would always take sides with the dispatcher!

Well, it all ended like this; I was on the end of my second year with them. I was running hard that week, as my son's 4th birthday was that following weekend. I had been out 2 weeks and was scheduled to be home for his b-day. I had to run hard to afford to get him a few presents, and a cake and all that stuff! Me and my children are really close so it would have really hurt him if I didn't get home. Anyways....I was on route from Denver CO to Joplin MO area. I was told since it was a friday nite delivery...That I would probably be deadheaded home to Kansas City Mo for my weekend home time. Well, I delvred load and by time I was mt dispatch was about ready to go home for nite. I done my mt call on OBC and called in to see what was next. Well, my dispatcher didnt know anything and was getting ready to leave so she trasferred me to a supervisor, I believe her name was "Sue", and she told me that there was nothing in area to pick-up and if I dont wanna wait, to just go on home. Well, I told her ok and dead headed home. Well, next morning I went out to check OBC and had about 10 messages. They were from my dispatcher and Tim Crowley! I called in and they asked me why I deadheaded home and I told them that Sue told me too! There was a big fuss about it and she denide to everyone telling me it was ok to deadhead home! So, I told them I was quiting and would be up to termanal by noon to turn truck in! They begged me to stay, but I couldn't stand to work for them anylonger. So, as promissed

I cleaned out there truck, turned it in and left keys and all my bills with company.....

Well, I had about $400.00 check for that week coming and they hold 2 weeks checks when you first get hired so I was expecting them. Well...I get a final paycheck of about $100.00!

I called Tim Crowley and he tells me that they took out for quote" FUEL, UNARUTHERISED MILES, EQUIPMENT ABONDAMENT, CLEANING FEE, AND OTHER CHARGES!!!!! He was very rude and even kind of threating! I had cleaned the truck out to spec., I never abandoned there truck nor anyones truck, I never signed anything giving anyone permission to deduct any moneys from my check! They have put my name on DAC showing anarutherised use of company equipment and abandonment! ]

Yet...they dont when a company sends a referance to them to sign! Yet ...Dac has it on there from them!!!!! They ruined my good DAC record, they stole my money and my son had a very very bad birthday that year!!! Im writting this now as I been talking to a lot of drivers around here that still...from this day has been ruined from them!!! And any driver that quits....gets there money stolen and a bad rapp sheet!!!!WARNING< DO NOT WORK FOR "WALLER TRUCK CO INC"!!!!!!!!

One thing a person should always do, wether it be turning in a truck, apartment, rental car, is take pictures! I have switched trucking companies 2 times in 9 years and both times the companies tried the same old thing like trying to charge me for cleaning, transporting truck to the main terminal, ect.. ect.. My last company tried to hold $600.oo back frome me for this b.s., unfortunatly when i drove the 300miles to there main office and walked in with a handful of photos of the truck and a signed receipt from the terminal manager were i turned the truck in they not only paid me my 600 but also an extra 150 for my time and effort of having to drive up there. I also received a one on one apology from the president of the company! Remember the common thought patterns of companies these days is stick it to the employee who quits, especially this seems true with most trucking companies. It is up to you to take every precaution you can to cover your butt!

Dave, at the moment Im not really sure what you can do to this guy. I mean yeah he is really pulling some fast ones. So I would try to think of all the illegal things he is doing. (I'm sure he's cheating on his taxes, stuff like that) then I would call up places like the labor board, I think theres a division of wage and hour law, so get in touch with them, maybe the attorney general, and I guess it couldnt help to report him to the BBB. Your off to a good start just getting the word out, and giving them a BAD name. You might also think about small claims court to get your proper pay. I think theres like a $50 filing fee. But if you go on Judge Judy or something like that, you can get that waived and even get a little money for appearing. (just a crazy thought, but you could really embarass this guy on national tv, as Im sure she would "let him have it") In this kinda situation where your not really sure of your options, or could be a hassle to get fair treatment (your word against his etc, etc.) Sometimes people have been known to result to vandalism. Sounds like this guy has a fleet of trucks that he really cares about. Be a shame if some of them got damaged. Also business's pay insurance on their property, So even if a front window got broken out or something, and they turn it in on insurance, there rates are gonna go up.. Good luck! ps... It sounds like you dont have any issues with their other drivers, but if you did-(you know, like a company kissass or something) and theres one of those 800 "hows my driving" type numbers on the truck, you could make their life difficult for them by making alot of calls. (be careful about caller id---plus 800 numbers track where your calling from anyway for billing purposes) Also if you call the local police departments alot (again anonymously--you can use your wife for variety) and say things like "man this crazy f*k in the waller truck almost took me out!", pretty soon theyre gonna get the idea this guy is "pushing his guys too hard" and "start watching" his trucks. But it sounds like you really just had issues with Timmy and the dispatchers. You could make their lives hard for them (for a little while) by going to Radio Shack (if you can find one these days where the people know about electronics) and getting yourself a radio on the same frequency. (or if you happened to still have a set of keys to the truck, or the window somehow "got smashed", you could help yourself to a free one) Put the radio in a car or something mobile, and dont stay in the same place too long...Eventually there gonna probably hafta change their frequencies (and your radio wont be as much fun) BUT if theyve got a lot of trucks it aint gonna be cheap replacing or upgrading all those radios, plus the dispacther station...(Say Hi to Sue for me!)
