I was walking into Walmart in my hometown which is a new store.  It had been snowing that day and I didn't realize that the black pavement and no trees blocking the wind made the parking lot dangerous.  I slipped and fell on my knees and hit pavement barely catching face.  I tore my miniscus in knee, sprained ankle and hurt back.  I keep getting run around.  I was told Walmart doesn't own the land however, the same people that own Walmart own Walmart Real Estate Trust which owns the land the parking lot sits on.  I have given statements to three different insurance companies including State Farm and keep getting run around.  I need surgery and am in constant pain for 5 months.  They have video of the event.  I had two witnesses who had to pick me up off the ground and help me into the store.  I will never shop at Walmart again and hope people start buying American goods and follow suit.

thank you.  yes, I plan on seieng a lawyer because they had not applied salt or sand to keep the drive from freezing over.   I just don't know who to go to and I was waiting until I had surgery which I did have last week.  I don't know the best way to find a GOOD lawyer.

Yes, I know Walmart cannot control the weather but I had been wearing boots, walked all day at college and my office and other areas.  Walmart had not put salt or sand or anything on the driveway because it was a new store to melt the ice.  The other places I had just left had kept the driveways and sidewalks cleared.  I have aked to see the records of what had been applied and they would not provide them.  When I drove out of the parking lot and turned my headlights on, the entire parking lot had a glaze of ice.  And it was not 3 feet of snow but 3 inches of snow.

Generally a store is not going to be held at fault if they are taking reasonable precautions to maintain the safety of it's customers.  So if you are in the middle of a blizzard with 3 feet of snow, they are constantly shoveling, using sand/salt.  If someone slips and falls they could say they were doing all they could and won't be held liable.  But if it had stopped snowing 7 hours ago and they can't show any proof that they have done anything to clear the way they could be found liable.

- Along the same lines.  If this is your first time in a "winter" climate that may show why you may not have known.  But if you have lived in a climate like this for more than a couple of years a statement like that may hurt you more than it helps because you "should" have known, and been more careful.

But since judges and juries are very unpredictable you may sue them and not have the ruling in your favor.  But if  you get the right combination they may find for you.

As suggested before you need to get a lawyer.  If a personal injury attorney thinks you have any case at all they will be more than happy to take you case on contingency and you won't pay a single cent unless you prevail.

You say it was snowing and cold.  Thus you knew the weather to be bad.  We have all fallen n bad weather.   It is just sad that people claim businesses responsible.  Did they do something to make you fall?  Did they leave an unsafe environment that they could control?

Falling on a side walk on ice or falling in a store because they didn't clean a spill is one thing.  Falling in a parking lot when it has been snowing is another. 

Either way they will give you their insurance company.   But they will not pay this.  At least I hope they won't  don't like when my prices go up to cover people making bogus claims.

The reason they are giving you a "run around" is because they are not at fault.   If you need surgery get it on your medical insurance.  Even if you truly believe they are at fault at this point I would get the surgery and sue for the damages.   But I hope you don't win as this is the kind of situation that makes america bad.  No one takes responsibility for their actions.  Trust me if the weather is crappy and  don't need to shop I don't shop.  But others do because when they fall it is never their fault.   It is always the store's fault.
