All banks have that provision in their terms and conditions. You probably should read through your account terms and conditions for whichever bank you have your account with. There is valuable information in there. It will explain what the right to setoff is as well as several other things you are authorizing the bank to do by having an account with them. You might be surprised. There will be a section in there that explains what to do to file a fraud claim. I don't know of any bank that doesn't require a signed affidavit. Which is probably why it took three weeks. But regardless, any time you communicate with any financial institution by telephone, for whatever reason, follow it up with something in writing.
