I began paying my support from date I was oredered to start paying at the time I was serving in the US Navy. Shortly there after I was summoned to see a referee for arrearage of some $400.00. I explained I began payments immediately and had plenty of proof. When I asked why I suddenly owed arrearage and for proof of such I got a major run around and was told "Just pay it!".
After 8 years of paying from my Navy check I ran into some difficulty paying after my discharge, due to a hard time finding work. I paid when I could. I tried to contact them to have my case reviewed and got no answer. Over the following time I ended up owing $5200 in arrearage, which I do not deny. They intercepted my 2001 State and Federal taxes in the amount of $2677, of which my child only received my State tax amount of $277.00 which took 6 months for them to get. None of the amount taken was credited to my case account.
They then intercepted my 2002 taxes in the amount of $4832.00. Again this has not yet been credited and my child has not seen a penny of this. The math is not difficult. I owed $5200 and they now hold over $7200.00 of my money. I do not have it and my child or her mother does not have it...Where is it? The Friend of the Court should be held accountable. I also know now that I am not the only one in this situation.

I too have had my taxes taken for arrears. I been trying to find out were my taxes were applied it has been 2yrs and nobody can tell me were it was sent. So again they took more taxes this year. I did not have any arrears they were paid in 1991. I did not have any problems until 2000. Wyane county just took the taxes. When i tried to called the give u the run around. I have went to the state Representive to get to the bottom his name is Mike Brady. I was able to recieve records from Wyane county. Call Mike Brady maybe he can help his number is 1-877-543-2660 ext 467.

Pandora is correct about the tax oney. Tax monies are sent to FOC all through the year, depending on when you file your taxes ad when you get the letter stating that your tax refund will be intercepted. It usally takes about 90 days from the time you receive the letter stating that your refund was taken, for FOC to get the money. As for your child not receiving your Federal refund, it could be that there is an arrearage owed to the Family Independence Agency (FIA). Federal law states that monies collected by Federal Refund, must go to FIA first, once paid in full, then any remaining money from the federal refund can then go to the mother and child. All State Refunds can go to the mother and child first.

I can not explain last years return but I can give you the answer to this years. The IRS does not send check out right away. According to the Sanilac County Friend of the Court they receive these checks in batches all the way until October. If you need help clearing up your problem there are a couple of different law offices that will help. One is FRED (Father Rights for Equality in Divorce) the other is ADAM AMerican Divorce ASSoc for Men 248-356 2326 or WWW.mens-divorce.com. Also there is a group Call Dads Of Michigan www.dadsoofmichigan.com 248-559-DADS they may also be able to help. They will at least be able to give you the FOC in Lansings Email address and contact information. Good luck this is an never ending battle and they seem to be the worst in the county.
